HomeMy WebLinkAbout98-364 OFFICIAL RECORDS OF MOHAVE COUNTY, AZ .lOAN MC CALL, MOHAVE COUNTY RECOROER 10/07/!~8 02:45P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUF'ERVISORS RECOROIN6 FEE RESOLUTION NO. 98-364 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 4 AND 5, LAKE MOHAVE COMMERCIAL CENTER, IN SECTION 2, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR ON-SITE PROPANE SALES IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Lou S. Cleghorn of Dolan Springs, Arizona, and WHEREAS, this property is located east of US Highway 93 and south of Pierce Ferry Road. The site is accessed from US Highway 93 via northeast on Pierce Ferry Road to Lloyd Street, then southeast on Lloyd Street to Don Nel Drive, then northeast on Don Nel Drive to the site, located on the southeast side approximately equal distance between Lloyd Street and Penny Street. The property has a single-family residence and an accessory building on it, and the terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of other general commemial businesses, the county library, and several single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for on-site propane sales in a C-2 (General Commercial) zone. The Mohave County General Plan designates this area as a Rural Development Area and Dotan Springs is an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: PAGE 2 OF' 2 RESOLUTION NO. 98-364 Page 2 1. This Zoning Use Permit is for on-site propane sales in a C-2 (General Commercial) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. In addition, the applicant shall provide right-of-way, road, and drainage improvements as required by the Mohave County Engineer prior to site plan approval. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Zoning Use Permit as recommended by the Mohave County Plannin~,~Jit~l/?maingg,,x~ '7,'~tt~ Commission' and outlined herein. o.^ so s
