RESOLUTION NO. 98-365
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A PORTION OF PINTO ROAD
BETWEEN STATE HIGHWAY 93 AND THE NW¼ OF SECTION 5, AND A PORTION OF
MARBLE DRIVE BEGINNING AT THE NW¼ OF SECTION 5 AND EXTENDING EASTWARD
3,945.34 FEET, PARALLEL TO THE NORTHERN SECTION LINE, IN SECTION 5, TOWNSHIP
20 NORTH, RANGE 13 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
5, 1998, a public hearing was conducted to determine whether approval should be granted to abandon the
above-described road rights-of-way as requested by Leo Horner, President, Silver Ranch Corporation of
Kingman, Arizona, and
WHEREAS, this property is located east of State Highway 93, approximately one mile south of the
Interstate 40/Highway 93 Interchange. The site is accessed from State Highway 93 via north on Pinto Road.
The terrain is relatively flat and slopes slightly toward the southwest. The surrounding land uses consist of
vacant parcels and a few single-family residences. A wash crosses the intersection of Pinto Road and
Marble Drive, and
WHEREAS, the Mohave County Public Works Department objects to the roadway abandonment.
Even though the applicant will provide an alternate access for parcels within this development, the
abandonment would eliminate a portion of two section line roads and is contrary to Mohave County's policy
of establishing a road network along section lines, and
WHEREAS, Mohave Electric Cooperative objects to the abandonment of the roads because their
power lines are placed along the alignments and the roads are used to access these lines, and
WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be
in Zone A, in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended.
d. The site has legal access.

e. There are no significant environmental features affecting the site except the above mentioned
special flood hazard area.
f. The physical roadway is not placed entirely within the dedicated alignments for Pinto Road
and Marble Drive.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Connnission on
September 9, 1998, the Connnission recommended DENIAL for the Abandonment based on the following:
1. The abandonment would eliminate a portion of two section line roads and is contrary to
Mohave County's policy of establishing a road network along section lines.
2. Mohave Electric Cooperative has power lines placed along the aligmnents and the roads are
used to access these lines.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingmm~, Mohave County, Arizona, September 19, 1998, and September 26, 1998, and posted
September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 5, 1998, DENIED this Abandonment as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
