HomeMy WebLinkAbout98-366 INDEXED 98060626 BK 3173 F'G ~3~ OFFICIAL RE(:QRDS OF MOHAVE {:O!JNTY~ AZ JOAN MC CALL, MOHAVE COUNTY RE(:ORDER 1¥07/199~ 02:46P PAGE I OF 2 ~OHAVE COUNTY BOARD OF SUF'ERVISORS RECORDING FEE O.OO RESOLUTION NO. 98-366 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF NEAL ONE SUBDIVISION, TRACT 3048, BEING A SUBDIVISION OF A PORTION OF THE NE¼ OF SECTION 29, TOWNSHIP 22 NORTH, RANGE 16 WEST, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 1998, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by the owner/developer Mary Brock, Kingman, Arizona, for the above-described Preliminary Plan. The new project engineer is Mohave Engineering Associates, Inc., Kingman, Arizona, and WHEREAS, the property is located approximately one and one-half miles north of the City of Kingman, situated between Thompson Avenue, Jagerson Avenue, Marshall Drive and North Castle Rock Road. The property is accessed via State Route 66, then northwesterly on Thompson Avenue, and WHEREAS, the Preliminary Plan depicts 161.1 acres subdivided into 764 single-family residential lots, and six drainage parcels. The residential lots range in size from 6,000 to 8,500 square feet, giving the development an average density of 4.88 dwelling units per acre, and WHEREAS, the project engineer has indicated in a letter dated July 14, 1998, that an Extension of Time is being requested in order to allow more time to process Final Plats for the 18 phases proposed by the developer for this subdivision. No phases have yet been recorded, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 5, 1994, per BOS Resolution No. 94-233. The first Extension of Time for the approval of the Preliminary Plan was granted on October 7, 1996, per BOS Resolution No. 96-357. The second extension was granted on December 1, 1997, per BOS Resolution No. 97-442. Subdivision Regulation, Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and PAGE '~ Of: .: ''~ r_.'.K S':V?$ F'G 435 FEE,5?8060626 RESOLUTION NO. 98-366 Page 2 WHEREAS, this action, if approved, will be the third Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request complies with the Extension of Time Policy because the Final Plat for Phase A of this subdivision has, since the last extension, been actively processed, and is was conditionally approved by the Board of Supervisors on September 8, 1998, per BOS Resolution No. 98~332. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 1998, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 94-233, 96-357 and 97-442. 2. This Extension of Time will be in effect until July 5, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1998, and posted on September 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 1998, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
