RESOLUTION NO. 99-1
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF BEAVER DAM HEIGHTS, TRACT 3506, BEING A
SUBDIVISION OF A PORTION OF THE E~ OF THE NW¼ OF SECTION 33, TOWNSHIP 41
NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by one of the developers, Jim Martin, Mesquite, Nevada, for the above-described
Preliminary Plan. The project engineer of record is MCM Engineering, Inc., Mesquite, Nevada, and
WHEREAS, the property is located approximately one and one-half miles north of the County
Highway 9! interchange with Interstate 15, north of the outlying community of Beaver Dam/Littlefield. The
site is accessed via Interstate 15, then north along and west of County Highway 91, and
WHEREAS, the Preliminary Plan for Beaver Dam Heights, Tract 3506, depicts 19.29 acres
subdivided into 77 single-family residential lots, one landscaping parcel, one drainage parcel, and two
parcels designed for sewage treatment facilities and easements. The residential lots range in size from 6,000
to slightly over 23,000 square feet, with an average lot size of 6,200 square feet, and
WItEREAS, the developer has indicated in a letter dated November 4, 1998, that an Extension of
Time is being requested due to "unresolved problems" which require additional time to be addressed, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on March I0, 1997, per BOS Resolution No. 97-58. Subdivision Regulations, Article 3.10-I,
states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in
increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively
processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be
terminated.", and
WI-IEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have'recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this action, if approved, will be the first Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. Ail notices have been advertised and posted according to regulations.
b. This request complies with the Extension of Time Policy, since a final plat has been
submitted to Mohave County for review in the past year.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 9, 1998, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution No. 97-58.
2. This Extension of Time will be in effect until March 10, 2000.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 5, 1999, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
