A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT
ON LOT 4, BLOCK 221 AND LOT 1, BLOCK 222, VIRGIN ACRES, TRACT NO. 1, IN SECTION
32, TOWNSHIP 41 NORTH, RANGE 15 WEST, FOR A WELL PUMP SITE, WATER STORAGE
TANK, A RADIO COMMUNICATION TOWER (NOT TO EXCEED 100 FEET), A RADIO
EQUIPMENT SHELTER AND RELATED ITEMS, IN AN A-R (AGRICULTURAL-
RESIDENTIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1999, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use
Pemfit should be granted for the above-described property as requested by AAT Coaununications
Corporation, representing the Beaver Dam Water Company, of Beaver Dam, Arizona. AAT
Communications is constructing the communications facility on this site, and
WHEREAS, this property is located west of Mohave County Highway 91 and northwest of the
Littlefield Interchange, in the Beaver Dam area. The site is accessed from Highway 91 via west on a local
road known as "Old Pioneer Road" to the southern boundary of Section 32, then west on a public road (not
named) in Virgin Acres, approximately one-half mile to the site on the north side. The property is vacant
and flat, sloping slightly to the east. The surrounding land uses consist of vacant land and a few single-
family residences. There are no significant drainage patterns crossing the property. The Mohave County
General Plan designates this area as a Rural Development Area and an Outlying Community, and
WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of
Supervisors on August 5, 1996, per BOS Resolution No. 96-274 and was amended on December 2, 1996,
with BOS Resolution No. 96-402, and
WHEREAS, the applicant requested in a letter dated October 21, 1998, that the Zoning Use Permit
be extended in order to complete the construction of the communications facility on this site, and
WHEREAS, this will be the first and second Extension of Time for this property, and
VOtEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
g. This request complies ~vith the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 9, 1998, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use
Permit subject to the following:
1. Compliance with the conditions of BOS Resolution Nos. 96-274 and 96-402.
2. This Extension of Time will b'e in effect until August 5, 1999.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution Nos.96-274 and 96-402.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 5, 1999, APPROVED this Extension of Time for a Zoning Use Permit as recommended
by the Mohave County Planning and Zoning Commission and outlined herein.
