HomeMy WebLinkAbout99-007 RESOLUTION NO. 99-7 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 4, 5, AND 6, BLOCK 1, MOHAVE VALLEY BUSINESS PARK, TRACT 4029-A, AND THE NORTH 333.31 FEET OF THE EAST 533.47 FEET, EXCLUDING THE EAST 358.47 FEET OF THE N~ NE¼ NW¼ SW¼ OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A MANAGER'S RESIDENCE IN A C-MO (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Phillip L. Carter of Agoura, California and John Day of Bullhead City, Arizona, WHEREAS, this property is located east of State Highway 95, between Camp Mohave Road and E1 Rodeo Road. The site is accessed from State Highway 95 via east on Aztec Road to the site, located on the north side approximately 500 feet east of State Highway 95. The property is vacant and relatively flat, sloping slightly to the southwest toward the Colorado River. The surrounding land uses consist of vacant lots, general commercial businesses to the west, and single-family residences to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an on-site manager's residence. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. RESOLUTION NO. 99-7 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for an on-site manager's residence in a C-MO (Commercial- Manufacturing/Open Lot Storage) and activities related thereto. 2. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 3. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
