HomeMy WebLinkAbout99-008 RESOLUTION NO. 99-8 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE E¼ NE¼ OF SECTION 27, EXCLUDING THE 420-FOOT BY 1,320-FOOT TRIANGLE IN THE SW CORNER, IN TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A RECREATIONAL VEHICLE PARK AND THREE RESIDENCES IN AN R-E (RESIDENTIAL-RECREATION) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Yancey D. and Beverly J. Sexton of Topock, Arizona, and WHEREAS, this property is located south of the Golden Shores community mad north of Topock along the Topock-Oatman Highway (Old US Highway 66). The site is accessed from Interstate 40 via the Topock exit to the Topock-Oatman Highway (County Highway 10) to the site, located approximately two and one-quarter (2¼) miles north of Interstate 40. The property is vacant and the terrain is rolling hills, generally sloping to the southwest toward the Colorado River. The Warm Springs Wash crosses the northern half of the property from the northeast to the southwest. The surrounding land uses consist of vacant land and several recreational vehicle parks along the Topock-Oatman Highway toward the Colorado River. There are no significant drainage patterns noted, except for the Warm Springs Wash, and WHEREAS, the applicant requests this Zoning Use Permit for a recreational vehicle park and three residences in an R-E (Residential-Recreation) zone. The Mohave County General Plan designates this area as a Rural Development Area, and Golden Shores and Topock are considered Outlying Communities, and WHEREAS, a review of FEMA FIRM Panel #040058-2816C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Warm Springs Wash and the Special Flood Hazard Area. RESOLUTION NO. 99-8 Page 2 VfHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a recreational vehicle park and three residences in an R-E (Resident/al-Recreation) zone and activities related thereto. 2. The creation of the three single-family residential lots will require the submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details. Each lot must meet the minimum lot size for the R-E (Residential-Recreation) zone, which is 20,000 square feet. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.J (Recreational Vehicle Park Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. In addition, the applicant shall provide right-of-way, road, and drainage improvements as required by the Mohave County Engineer prior to site plan approval. Also the applicant shall submit a traffic impact analysis with the site plan to substantiate whether turning lanes for access on and off of Historic Route 66 are required. 4. The applicant shall have the portion of Historic Route 66 which crosses his property surveyed and its location defined, and it shall be dedicated to the public and accepted by the Mohave County Board of Supervisors as road right-of-way. This may be accomplished via a separate instrument. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. VOtEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 99-8 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
