HomeMy WebLinkAbout99-009 RESOLUTION NO. 99-9 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF LOT 12, BLOCK H, GOLDEN SAGE RANCHOS, UNIT 68, IN SECTION 27, TOWNSHIP 22 NORTH, RANGE 19 WEST, FROM A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE TO A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to detemfine whether an Extension of Time for a Rezone should be granted for the above-described property as l'equested by Harold J. and Rose H. Woods of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68 between Egar Road and Estrella Road. The site is accessed from State Highway 68 via north on Egar Road to the property, which is located on the east side of Egar Road approximately 970 feet north of Todilto Drive. A mobile home and a garage are on the property. The terrain is relatively flat and slopes slightly toward the northeast. The surrounding land uses consist of vacant parcels and a few widely scattered single-family residences. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on January 5, 1998, via BOS Resolution No. 98-20. This Extension of Time will allow the applicant time to complete the required survey and parcel map and the other conditions as required by BOS Resolution No. 98-20, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-20, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2125C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Sacramento Valley/Golden Valley Area Plan. RESOLUTION NO. 99-9 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-20. 2. This Extension of Time will be in effect until January 5, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
