A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 92-148, THE
CONDITIONAL APPROVAL OF A REVISED PREUMINARY SUBDIVISION PLAN FOR
VALLEY PARK ESTATES, TRACT 3041, A SUBDIVISION OF A PORTION OF PARCEL 293,
1N THE SE¼ OF THE SW¼ OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE
GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
5, 1999, a public hearing was conducted to determine whether the conditional approval for the above-
referenced Preliminary Plan should be amended as requested by the owner/developer, A1 Haley, Delbar
Enterprises, Ltd., Golden Valley, Arizona. The project engineer of record is Mohave Engineering
Associates, Inc., Kingman, Arizona, and
WHEREAS, one of the conditions of the Preliminary PIan approval for this subdivision required
the developer to construct a six-foot block wall around the perimeter of the development. The developer
proposes a "private, gated community," and the wall was required to accommodate that proposal, as well
as serving as a physical barrier to prevent double-access to lots in the subdivision. The developer, in a
request dated October 30, 1998, proposes the construction of a four-foot chain link fence, along *vith
oleanders or other shrubbery, and electronically operated gates in lieu of the block wall. The proposal
requires the amendment of BOS Resolution No. 92-148, which included the condition for the wall, and
WHEREAS, the original resolution stated that the "Commission would consider an engineered
design to assure lot protection and non-access in lieu ora block wall." Though the subdivision design has
not been engineered to eliminate the double-fronted lots, the form of ban-ier and method of screening appear
to require consideration by the Commission, and
WHEREAS, the Public Works Department has expressed "no objections" to this proposal,
"conditional to" adherence with the Public Works memo dated October 16, 1998, regarding drainage
concerns and the submittal of a drainage report addendun~, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 9, 1998, the Coaunission recommended APPROVAL of this amendment to BOS Resolution No.
92-148, subject to the following:
1. Condition 5.A of BOS Resolution No. 92-148 be amended to read: "A buffer in the form of
a four (4') foot chain link fence and vegetative screening, and a one (1') foot vehicular non-
access easement shall be required along all double-fronted lots within this subdivision."

2. The comments made in the Public Works Department review letter dated October 16, 1998,
regarding drainage concerns and the submittal of a drainage report addendum with the
continued processing of the subdivision plat, shall be addressed.
WHEREAS, the advertising requirements have been met throughout this subdivision process as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 5, 1999, APPROVED this amendment to BOS Resolution No. 92-148, as
recommended by the Mohave County Planning and Zoning Commission and outlined herein.
