HomeMy WebLinkAbout99-020 RESOLUTION NO. 99-20 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 131,138, 139, AND 140, MEADVIEW, IN SECTION 11, TOWNSHIP 30 NORTH, RANGE 17 WEST, FOR A CHURCH AND OFFICES IN AN R-E (RESIDENTIAL-RECREATION) ZONE, IN THE MEADVIEW PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Pernfit should be granted for the above-described property as requested by Paul Daniel, Pastor, of the First Southern Baptist Church of Kingman, the sponsor of the Meadview Baptist Church in Meadview, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road, between Meadview Boulevard and Mohave Lane. The site is accessed from Pierce Ferry Road via east on Meadview Boulevard to the site, located on the north side approximately 1,000 feet east of Pierce Ferry Road. The property is vacant except for Lot 131, which has a garage on it. The terrain is gently rolling hills, generally sloping to the northeast. The surrounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a church and offices in an R-E (Residential-Recreation) zone. The Mohave County General Plan designates this area as a Rural Development Area and the Meadview area as an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1300B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on December 9, 1998, the Conunission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-20 Page 2 1. This Zoning Use Permit is for a church and offices in an R-E (Residential-Recreation) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. In addition, the applicant shall provide right-of-way, road, and drainage improvements as required by the Mohave County Engineer prior to site plan approval. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
