HomeMy WebLinkAbout99-022 INDEXED .i~af,l PIC C~I_L.~ ~!OFICWE h l::..uR,..!,!,; FEE RESOLUTION NO. 99-22 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 460, GOLDEN HORSESHOE RANCHOS, UNIT 2, IN SECTION 7, TOWNSHIP 27 NORTH, RANGE 19 WEST, FOR A WATER TANK IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at thc regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Ralph .L McGrath, President, GHR Development, Sco~tsdale, Arizona, and WHEREAS, this property is located east of US Highway 93 and north of White Hills Road. The site is accessed from US Highway 93 via easterly on White Hills Road approximately seven miles to Skipper Boulevard, then north-northeast on Skipper Boulevard approximately four-tenths (0.4) mile to Spear Boulevard, then northeasterly on Spear Boulevard approximately one and two-tenths (1.2) miles to Lunado Drive, then south on Lunado Drive to Olancha Drive, then southwest on Olancha Drive to Lodi Drive, then southeast on Lodi Drive to the site, located at its terminus. The property is vacant and the terrain is rolling hills, generally sloping slightly to the south. The surrounding land uses consist of vacant lots to the north, west, and south. There is Bureau of Land Management (BLM) land to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Pern~it for a water tank for White Hills Water Company in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-1600B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 99-22 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a 25, 000-gallon water storage tank in an A-R (Agricultural- Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. The tank shall be painted an earth tone color. 3. The appropriate zoning, building, enviromnental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. MOHAVE COUNTY BOARD OF SUPERVISORS
