HomeMy WebLinkAbout99-023 INDEXED IREE:C)RDZE!,I~]~ FEE: r~ RESOLUTION NO. 99-23 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 17, 18, 31 AND 32, GATEWAY ACRES, TRACT 10, IN SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A RECREATIONAL VEHICLE PARK IN AN A (GENERAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by John R. and Mary A. Miller of Phelan, California, and WHEREAS, this property is located east of US Highway 93 and north of Pierce Ferry Road. The site is accessed from Pierce Ferry Road via north on Bullhead Road to the site, located on the west side approximately 600 feet north of Pierce Ferry Road. The property has a single-family residence on it and the terra'm is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of a few scattered single-family residences, vacant lots, and several general commercial businesses along Pierce Ferry Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a Recreational Vehicle Park in an A (General) zone. The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs is an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant enviromnental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-23 Page 2 1. This Zoning Use Permit is for a Recreational Vehicle Park in an A (General) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.J (Recreational Vehicle Park Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. In addition, the applicant shall provide right-of-way, road and drainage improvements as required by the Mohave County Engineer prior to site plan approval. The main access will have to be specified on the site plan. Also, the applicant shall submit a traffic impact analysis with the site plan to substantiate whether turning lanes for access on and off of Pierce Ferry Road are required. All internal roads and spaces shall be constructed with dust- free and durable material. 3. The right-of-way from the main access to Pierce Ferry Road will have to be acquired and dedicated to the public at the minimum Mohave County Standards. The logical choice for the main access appears to be Bullhead Road. If Bullhead Road is used, 42 feet will have to be dedicated to the public from the access point to Pieme Ferry Road and accepted by the Mohave County Board of Supervisors as road right-of-way. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not cormnenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tt 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Commission and outlined herein.
