HomeMy WebLinkAbout99-026 RESOLUTION NO. 99-26 A RESOLUTION SETTING FORTH A REZONE OF THAT PORTION OF THE S~ OF SECTION 11, LYING SOUTHERLY OF CACTUS WREN ROAD BETWEEN STOCKTON HILL ROAD AND BULL MOUNTAIN DRIVE, AND THAT PORTION OF SECTION 14, LYING BETWEEN STOCKTON HILL ROAD AND BULL MOUNTAIN DRIVE, EXCLUDING PARCEL 37-B, AS SHOWN ON PARCEL PLATS BOOK 8, PAGES ll-llB, TO BE SUBDIVIDED AND KNOWN AS CEDAR RIDGE ESTATES, TRACT 3060, IN TOWNSHIP 22 NORTH, RANGE 17 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, 1N THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Roger W. Sayles, representing the Sayles Family Trusts of Kingman, Arizona, and WHEREAS, this property is located north of the City of Kingman and east of Stockton Hill Road. The site is accessed from the City of Kingman via north on Stockton Hill Road to the site, bounded by Stockton Hill Road on the western boundary, Bull Mountain Road on the eastern boundary, mad Cactus Wren Road on the northern boundary. The property is vacant and the terrain is gently rolling hills, generally sloping to the southeast. The surrounding land uses consist of vacant land and single-family residences. There are several significant drainage patterns crossing this property from the northwest to the southeast, and WHEREAS, the applicant requests this zone change to allow for the proposed CEDAR RIDGE ESTATES, Tract 3060, Subdivision. The applicant proposes to divide the 274-acre parcels into 38 lots varying in size from 5.0 acres to 9.6 acres, averaging 6.8 acres per lot. The Mohave County General Plan designates this area as a Suburban Development Area and the Long Mountain Area Plan designated this area as RR/5A (Rural Residential/Five Acre Minimum Lot Sizes), and WHEREAS, the proposal of rural-sized lots greater than five acres without water service conforms to the Long Mountain Area Plan, but the Mohave County General Plan requires that Suburban Development Areas are provided with Suburban services, as follows: Policy 16.4: Mohave County shall consider proposals for rural residential development in Suburban Development Areas, but all suburban development facilities and services will be required. RESOLUTION NO. 99-26 Page 2 General Plan Goal 16: To establish Suburban Development Areas (SDAs) in Mohave County for suburban development with appropriate land uses and services. Policy 43.6: Projects in a suburban area should be serviced by an organized water system. Policy 43.8: The County should not approve a "dry" subdivision unless it is in a Rural Development Area. General Plan Goal 43: To plan for adequate water supply systems, at levels appropriate to meet the service and emergency needs of urban and suburban areas. WHEREAS, a review of FEMA FIRM Panel #040058-2155B and #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. Ali notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan and the Long Mountain Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. The Planning and Zoning Commission found that the Long Mountain Area Plan with its requirement for five-acre minimum lot sizes took precedence over the General Plan as stated in Policy 62.2. In addition, the Commission believed that there was enough water available as shown in the water report provided by Mr. Sayles. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property, to be known and subdivided as CEDAR RIDGE ESTATES, Tract 3060, will be rezoned to A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size). 2. The rezone will be effective upon the recordation of the Final Plat of CEDAR RIDGE ESTATES, Tract 3060, or for each phase of CEDAR RIDGE ESTATES, Tract 3060, if the subdivision is phased and the rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11- 829E. 3. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. RESOLUTION NO. 99-26 Page 3 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, amd posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
