A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 11, SUNHAVEN
HOMESITES, IN SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A RESIDENCE
IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mobave County Board o£ Supervisors held on January
5, 1999, a public hearing was conducted to determine whether a Zoning Use Pem~it should be granted for
the above-described property as requested by Marjorie Lee and Edward Westargaard of Kingman, Arizona,
and
WHEREAS, this property is located northwest of State Highway 66 (Old US Highway 66) and
southwest of Sunhaven Lane, north of the City o£ Kingman. The site is accessed from State Highway 66
via northwest on Sunhaven Lane to Able Drive, then southwest on Able Drive to the site, located on the
southeast side approximately 125 feet southwest of Stmhaven Lane. The property has an existing structure
on it and the terrain is relatively fiat, sloping slightly to the southeast. The surrounding land uses consist
of single-family residences, vacant lots, and several commercial businesses. There are no significant
drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2 (General
Commercial) zone. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a residence in a C-2 (General Commercial) zone and activities
related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opi~fion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Plarming and Zoning Commission and outlined herein.
