HomeMy WebLinkAbout99-029 RESOLUTION NO. 99-29 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE S¼ SE¼ OF SECTION 34, LYING SOUTHERLY OF THE INTERSTATE 40 FRONTAGE ROAD, TOWNSHIP 21 NORTH, RANGE 17 WEST, FOR A RESIDENCE IN A C-MO/4A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by James P. Thompson of Kingman, Arizona, and WHEREAS, this property is located south of Interstate 40 and northeast of the McConnico Interchange. The site is accessed from Interstate 40 via the McConnico Interchange to the south Frontage Road, then northeast on the Frontage Road to the site, located on the southeast side approximately two miles northeast of the McConnico Interchange. The property has an existing building on it and the terrain is relatively flat, sloping to the west. The surrounding land uses consist of vacant property and several roadside businesses along the Frontage Road and the railroad to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-MO/4A (Commercial-Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. RESOLUTION NO. 99-29 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 9, 1998, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a residence in a C-MO/4A (Commercial-Manufacturing/Open Lot Storage/Four Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall temainate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 16, 1998, and posted on December 18, 1998, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Commission and outlined herein. r~ ~ MOHAV~RVISORS
