A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A
PORTION OF THE SE¼ OF SECTION 34, TOWNSHIP 41 NORTH, RANGE 15 WEST, FROM
R-E/10A (RESIDENTIAL-RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE TO M
(GENERAL MANUFACTURING) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
1, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should
be granted for the above-described property as requested by William L. Gates and John Johnson, dba Virgin
River AZ, of Grand Junction, Colorado, and
WHEREAS, this property is located north of Interstate 15 and east of the 1-15 Farm Road Exit in
the Littlefield area. The site is accessed from Interstate 15 via the 1-15 Farm Road Exit to the Frontage
Road, then northeast on the Frontage Road to the site, located on the north side of the road. The property
is vacant and relatively flat, sloping slightly to the north and west toward the Virgin River. There are several
significant drainage patterns crossing the property, mostly along the northern part toward the Virgin River.
The Mohave County General Plan designates this area as an Urban Development Area and an Outlying
Community. The rezone conforms to the Virgin River Communities Area Plan, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on August 7, 1995, via BOS Resolution No. 95-314. This M (General Manufacturing) zoned portion is for
a package sewage treatment plant. It was extended for the first time with BOS Resolution No. 96-362 on
November 4, 1996. A second Extension of Time was granted on April 6, 1998, via B OS Resolution No.
98-102, and
WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as
required by BOS Resolution No. 95-314, and
WHEREAS, the property owner has obtained complete analytical reports of three of the five water
wells and the test well, to determine the ambient ground water level and quality. Also, soil percolation rates
at the proposed wastewater treatment plant have been completed and the applicant has the documentation.
In addition, the applicant in the process of trying to get "Community Participation" to work with Arizona
Department of Transportation (ADOT) on the "Farm Road Interchange at Interstate 15" and to form an
Improvement District for the much needed services in this area. The applicant is also studying the most
feasible and affordable method of treating wastewater and installing a water system. The possibility of
obtaining potable culinary water from an existing well and/or water company or obtaining a new Certificate
of Convenience and Necessity is also noted in his letter of December 4, 1998, and

WHEREAS, this will be the third Extension of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates that a portion of the parcel
described is in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
fi There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
g. This request complies with the Extension of Time Policy, as Mr. Gates has made some
progress in accomplishing the conditions of approval of BOS Resolution No. 95-314.
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
January 13, 1999, the Commission recommended APPROVAL for an Extension of Time for a a Rezone
subject to the following:
1. Compliance with the conditions of BOS Resolution No. 95-314.
2. This Extension of Time will be in effect until August 7, 1999.
3. This will be the last Extension of Time unless more progress is made to complete the
conditions of BOS Resolution No. 96-362.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 13, 1999, and posted on January 15, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 1, 1999, APPROVED this Extension of Time for a Rezone as recommended by the
, Planning and Zoning Commission and outlined herein.
