HomeMy WebLinkAbout99-039 INDEXED RECORDING FEE 0,1)() RESOLUTION NO. 99-39 A RESOLUTION SETTING FORTH THE APPROVAL OF AN AMENDMENT TO THE VIRGIN RIVER COMMUNITIES AREA PLAN, TO AMEND THE LAND USE DESIGNATION FOR THE NWIA PARCEL 1, AS SHOWN ON PAGE 85, BOOK 2 OF PARCEL PLATS IN SECTION 11, TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM NC (NEIGHBORItOOD COMMERCIAL) TO COM (COMMERCIAL), AS DEPICTED ON MAP A-2, IN THE SCENIC/ARYADA AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on March 22, 1999, a public hearing was conducted to determine whether the Virgin River Communities Area Plan should be amended as requested by DeForest and Margaret Rall of Mesquite, Nevada, and WHEREAS, the site is located north of Elbow Canyon Road between Cottontail Road and Scenic Boulevard. The site is accessed from Mesquite, Nevada via east on Elbow Canyon Road to Zion Park Way, then north on Zion Park Way to where it becomes Cottontail Road, to the property located on the southwest comer of Spring Rain Drive and Cottontail Road. The property is vacant and gently rolling, generally sloping to the northwest toward the Virgin River. The surrounding land uses consist of vacant land and a few widely scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the Area Plan, adopted in May 1998, consists of approximately 25 square miles. This amendment will affect approximately 10 acres. The property currently carries a NC (Neighborhood Commercial) designation, allowing for small-scale commercial uses to serve the immediate neighborhood. The proposed COM (General Commercial) land use is designated for more intense commercial uses, such as retail, office, and service businesses, meeting community or regional needs. The access roads to this site, including Spring Rain Drive, Arvada Ranch, and Scenic Boulevard, are within the Scenic Improvement District, and WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The proposed action and the effect complies with the Virgin River Communities Area Plan. d. There are no significant environmental features affecting the site. RESOLUTION NO. 99-39 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 13, 1999, the Commission recommended APPROVAL for the Amendment subject to the following: 1. The Area Plan Land Use Map A-2 will be modified per Exhibit "A." WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 3, 1999, and posted March 5, 1999, as required by Arizona Revised Statutes and the Mohave Cmmty Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, March 22, 1999, APPROVED this Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
