HomeMy WebLinkAbout99-044 RESOLUTION NO. 99-44 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE NVg¼ NW¼, THE S¼ NW¼ AND THE NE¼ SW¼ OF SECTION 13, TOWNSHIP 22 NORTH, RANGE 20 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO C-RE/36A (COMMERCIAL-RECREATION/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Ronald E. and Christine Gardner of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68, west of Bapchule Road, northwest of the Golden Valley area. The site is accessed from State Highway 68 via north on Estrella Road to Jurassic Drive, then west on Jurassic Drive approximately 4.8 miles across Bureau of Land Management (BLM) land to the northeast comer of the property. The property has a single-family residence on it and is being used as a cattle ranch. The terrain is rolling hills. The runway and ranch complex is located within a valley. The surrounding land uses consist of vacant BLM land. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on November 3, 1997, via BOS Resolution No. 97-391, and WHEREAS, this Extension of Time will allow the applicant time to f'mish the required site plan and the other conditions as required by BOS Resolution No. 97-391. They are working with the Bureau of Land Management (BLM) to obtain a permanent easement across BLM land, and WHEREAS, the property owner was granted a Zoning Use Permit for the private landing strip on November 2, 1998, via BOS Resolution No. 98-404 as required by BOS Resolution No. 97-391, and WHEREAS, this will be the first Extension o£ Time for tiffs property, and WHEREAS, a review of FEMA FIRM Panel #040058-2125C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO. 99-44 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WltEREAS, at the public heating before the Mohave County Planning and Zoning Commission on January 13, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 97-391. 2. This Extension of Time will be in effect until November 3, 1999. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 13, 1999, and posted on January 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 1, 1999, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
