HomeMy WebLinkAbout99-056 RESOLUTION NO. 99-56 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 50-A AS SHOWN ON RECORD OF SURVEY BOOK 9, PAGE 56, A PORTION OF LOT 50, GATEWAY ACRES, TRACT 9, IN SECTION 9, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A PET KENNEL IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Paula Parent of Dolan Springs, Arizona, and WHEREAS, this property is located northwest of Pierce Ferry Road, between Eighth Street and Ninth Street. The site is accessed from Pierce Ferry Road via north on Del Norte Drive to the site, located on the east side approximately 350 feet north of Eighth Street. The property has a single-family residence and an accessory building on it. The terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant lots and a few scattered single-family residences. Along Pierce Ferry Road there are several general commercial businesses. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a pet kennel in an A-R (Agricultural- Residential) zone. The Mohave County General Plan designates this area as a Rural Development Area and the Dolan Springs Area is considered an Outlying Community, and WHEREAS, a review' of FEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on January 13, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-56 Page 2 1. This Zoning Use Permit is for a pet kennel in am A-R (Agricultural-Residential) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. That an additional 10 feet shall be granted in first position, as evidenced by a title report, to Mohave County, in trust for the public, to the existing 15-foot roadway easement known as Del Norte Drive to make a total of a 25-foot wide easement along this property. In addition, a 20-foot radius curve is required to be granted in first position, as evidenced by a title report, to Mohave County, in trust for the public, at the intersection of Del Norte Drive and the existing 30-foot easement along the south boundary of this property. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. Tiffs Zoning Use Pemfit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use 'of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of heating was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 13, 1999, and posted on January 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 1, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Pla~ing and Zoning Commission and outlined herein.
