HomeMy WebLinkAbout99-064 RESOLUTION NO. 99-64 WHEREAS, Mohave County, a political subdivision of the State of Arizona, COUNTY, is the of certain real property upon which is located at the Laughlin-Bullhead International Airport, and WHEREAS, the County has leased this property to the Mohave County Airport Authority, Inc., AUTHORITY, in accordance with A.R.S. §2-301, for the purpose of constructing, operating, and maintaining an airport, and uses incidental hereto, and WHEREAS, the County has previously authorized a stock subscription agreement ~vith the North Mohave Valley Corporation, NMVC, for the purpose of providing water/utility services to the airport pursuant to Resolution No. 96-72 dated February 5, 1996. WHEREAS, the AUTHORITY desires to enter into a Water Facilities Line Extension Agreement with the North Mohave Valley Corporation, NMVC, for the purpose of providing additional water utility services to the airport which would clearly benefit the airport and airport property, and WHEREAS, the terms of the Agreement require that certain on-site facilities as shall remain or become the property of the NMVC upon completion of construction, as well as certain perpetual non- exclusive rights-of-way and easements, which are necessary for the operation, maintenance and repair of the on-site facilities, WHEREAS, the retention of ownership of the on-site facilities by NMVC and the granting of ' easements and rights-of-way by the COUNTY would be in the best interests of the residents of the COUNTY. THEREFORE, BE IT RESOLVED in consideration of the enhancement of the airport property by the proposed water improvements and for other valuable consideration, the Mohave County Board of Supervisors hereby approves the Water Facilities Line Extension Agreement and authorizes NMVC to retain ownership of the certain described on-site facilities constructed on the subject property and also grants NMVC perpetual, nonexclusive rights-of-way and easements necessary for the operation, maintenance and repair of the on-site facilities.
