RESOLUTION NO. 99-72
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 17, BLOCK H, GOLDEN
SHORES, UNIT 8,1N SECTION 11, TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A CHURCH
FELLOWSHIP HALL IN AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH
MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Scott Seabury of Seabury Fritz Architects, Bullhead City, Arizona,
representing the Golden Shores Community Baptist Church of Golden Shores, Arizona, and
WHEREAS, this property is located on the south side of Cibola Drive, east of the Oatman-Topock
Highway. The site is accessed from the Oatman-Topock Highway (Old US Highway 66) via east on Ciboia
Drive to the site, located on the south side approximately 250 feet east of the Oatman-Topock Highway.
The property is vacant, but is paved and presently being used for parking for the church located on Lot 16
to the west. The terrain is relatively flat, sloping slightly to the west. The surrounding land uses consist of
vacant lots, single-family residences, and commercial business along the Oatman-Topock Highway. Them
are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a fellowship hall in support of the
existing Baptist Church on Lot 16 in an R-1 (Single Family Residential) zone. The Mohave County General
Plan designates this area as a Rural Development Area and Golden Shores is considered an Outlying
Community, and
WHEREAS, a review of FEMA FiRM Panel #040058-2805C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, Mohave Electric Cooperative (MEC) noted that on the proposed site plan with the
application, it appears the new building is within ten feet of existing overhead power lines. This would
violate the safety code for electric power lines, and
WHEREAS, this request ,,vas first heard by the Planning and Zoning Commission on December 9,
1998, as a Rezoning request and was approved by unanimous vote of the commission. At the Board of
Supervisors meeting on January 5, 1999, concern was expressed over the uses allowed in a R-M (Multiple-
Residential) zone. The Board referred the application to the Planning and Zoning Department to pursue as
a Zoning Use Permit, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
l. This Zoning Use Permit is for a fellowship hall in support of the existing Baptist Church on
Lot 16 in a R-1 (Single Family Residential) zone and activities related thereto.
2. The applicant will maintain at least a ten (10) foot clearance from the new building and the
existing overhead electric power lines.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use. In addition, the applicant shall provide
right-of-way, road, and drainage improvements as required by the Mohave County Engineer
prior to site plan approval.
4. The applicant shall provide a block wall buffer between the church property and the other
R-1 (Single Fanfily Residential) zoned property.
5. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
6. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, February 17, 1999, and posted on February 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 8, 1999, APPROVED this Zoning Use Pemfit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
