BK 3262 F'G 369 OFFICIAL RECORDS OF MOHAUE COUNTY~ AZ JOA~ M~ gALL, MOHAVE ~QUNTY RECORQER n3/Dt/1999 08:37A PAGE 1 OF 2 flOHAVE COUNTY BOAR~ OF SUPERVISORS RECORDING FEE O.OD RESOLUTION NO. 99-77 A RESOLUTION SETTING FORTH THE RESCISSION OF RESOLUTION P&ZC: 89-175 WHICH APPROVED THE REZONE OF PARCEL 182-B, AS SHOWN ON PARCEL PLATS BOOK 3, PAGE 66, IN SECTION 26, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1999, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolution for the Rezone for the above-described property as requested by the Mohave County Planning and Zoning Department. The property owners of record are Robert A. and Noreen P. Frisch of Kingman, Arizona, and WHEREAS, this property is located south of State Highway 68, between Aztec Road and Bacobi Road. The site is accessed from State Highway 68 via south on Bacobi Road approximately three miles to the site, located on the northwest corner of Bacobi Road and Chuar Drive. The property is vacant and relatively flat, sloping slightly to the southeast. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to A-R/3A (Agricultural- ResidentiaFFhree Acre Minimum Lot Size) by the Mohave County Board of Supervisors on September 5, 1989, via Resolution P&ZC: 89-175. There have not been any requests for an Extension of Time. None of the Conditions of Approval for the Rezone have been met. A certified letter ;vas sent informing the property owners that it would be scheduled for rescission. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1999, the Commission reconnnended that Resolution P&ZC: 89-175 be RESCINDED and that the zoning will revert to A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size), and RAGE 2 OF 2 BK ~26~ P6 370 FEE~9901~197 RESOLUTION NO. 99-77 Page 2 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 17, 1999, and posted on February 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE 1T RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 8, 1999, RESCINDED Resolution P&ZC: 89-175 and REVERTED the zoning to A-R/ 10A (Agricultural-Residential/Ten Acre Minimum Lot Size), as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
