WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway easements as requested by Armette Holmquist, Holmquist and Associates, Kingman, Arizona, representing Henry Shaw of Golden Valley, Arizona, and WHEREAS, the site is located south of State Highway 68, between Colorado Road and Verde Road. The site is accessed from State Highway 68 via south on Verde Road to Rainwater Drive, then west on Rainwater Drive to its intersection with San Pedro Road. The roadway easements to be abandoned are adjoining the northeast quarter of Parcel 316. Both roadways are graded and passable by a conventional vehicle. There are no significant drainage patterns, and WHEREAS, the applicant wishes to abandon these roadway easements to increase the net acreage of the parcel. This property was conditionally rezoned on February 1, 1999, per Board of Supervisors Resolution No. 99-46, from A-R/10A to A-R/2A. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, Valley Pioneers Water Company has reviewed the owner's petition and has no objection to the roadway easement abandonment, provided that a new easement is placed along San Pedro Road to protect the water company's existing six-inch water line, and WHEREAS, the Mohave County Department of Public Works recommends approval of the abandonment of these portions of Rainwater Drive and San Pedro Road, provided the abandoned portions are replaced with a drainage and public utility easement, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. A six-inch water line is within the western five feet of the San Pedro Road easement. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commissioa on February 10, 1999, the Commission recommended APPROVAL for the Abandmm~ent subject to the following: 1. The southern 20-foot portion of the existing roadway easement, known as Rainwater Drive, and the western 15-foot portion of the existing roadway easement, known as San Pedro Road, shall be granted to the public as a Public Utility Easement (PUE) and drainage easement. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 17, 1999, and February 24, 1999, and posted February 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 8, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
