HomeMy WebLinkAbout99-081 INDEXED IVI[C~OFILIV~ c~'~014201 BE 3262 F'G 377 OF'F~C[AL RECORDS OF HOH~UE COUNTY, AZ · JO~N H(: C:~LL~ HOH~VE COUNTY RECORDER MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 99-81 A RESOLUTION SETTING FORTH A REZONE OF GOVERNMENT LOT 3, EXCLUDING THE NORTH 420 FEET OF THE WEST 210 FEET, AND THE NORTH 1,030 FEET OF THE EAST 900 FEET, AND THE NORTH 30 FEET OF THE REMAINING 210 FEET, IN SECTION 1, TOWNSHIP 20 NORTH, RANGE 14 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/ THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/12A (AGRICULTURAL- RESIDENTIAL/TWELVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone tire above- described property as requested by Everett S. Nance, Sr., and M. Carol Nance of Diamond Bar, California, and WHEREAS, this property is located south of Interstate 40 and west of U.S. Highway 93. The site is accessed from Interstate 40 via southerly on U.S. Highway 93 to Hidden Valley Road, then west on Hidden Valley Road approximately one and one-quarter miles to the property, which is located on the south side of Hidden Valley Road. The property has a single-family residence on it and the terrain is gently rolling hills. The surrounding land uses consist of vacant parcels and a few widely scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to legalize zoning on the 16.63-gross-acre parcel. No land division is proposed. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Ama, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. e. The site DOES NOT have legal access. f. There are no significant environmental features affecting the site. RESOLUTION NO. 99-81 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This parcel will be rezoned A-R/12A (Agricultural-Residential/Twelve Acre Minimum Parcel Size). 2. That a 42-foot road right-of-way along the north boundary of the property, known as Hidden Valley Road, and that a 35-foot road right-of-way along the east boundary of the property shall be dedicated to the public and accepted by the Mohave County Board of Supervisors via a separate instrument. 3. The eight feet adjoining all rights-of-way shall be granted to the public as a Public Utilities Easement (PUE) via a separate instrument. 4. The owner shall obtain legal access for this property, and the access to the property shall be in conformance with minimum Mohave County Standards. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. 6. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the oxvner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
