RESOLUTION NO. 99-83
A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 94-213 AND
RESOLUTION P&ZC: 84-160 WHICH APPROVED THE REZONE AND THE EXTENSION OF
TIME FOR THE REZONE FOR A PORTION OF PARCEL 236, IN SECTION 35, TOWNSHIP 23
NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8,
1999, a public hearing was conducted to determine whether approval should be granted for the Rescission
of the Resolutions for the Rezone and the Extensions of Time for the Rezone for the above-described
property as requested by the Mohave County Planning and Zoning Department. The property owners of
record are Harvey and Joann Millermon of Kingman, Arizona, and
WHEREAS, this property is located on the northeast corner of Stockton Hill Road and Jane Avenue.
The site is accessed from the City of Kingman via north on Stockton Hill Road to the site, located on the
northeast corner of Stockton Hill Road and Jane Avenue. The property is vacant, except for mail box
clusters for the Post Office and several water tanks for water distribution. The property has not been
improved for commercial uses. There are no significant drainage patterns, and
WHEREAS, this property was conditionally approved for a rezone to C-2 (General Commercial)
by the Mohave County Board of Supervisors on July 16, 1984, via Resolution P&ZC: 84-i60. It was first
extended on July 5, 1994, with BOS Resolution No. 94-213. A certified letter was sent to the property
owners notifying them that the approval of their mzoning has expired and an Extension of Time was
required. There were no responses to the Planning and Zoning Department's inquiry. Another certified
letter was sent informing the property owners that it would be scheduled for rescission. The Mohave County
General Plan designates this area as a Suburban Development Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site has legal access.
d. There am no significant enviroamental features affecting the site.
WHEREAS, at the public hearing befbre the Mohave County Planning and Zoning Commission on
February 10, 1999, the Commission recon~nended that BOS Resolution No. 94-213 aJ~d Resolution P&ZC:
84-160 be RESCINDED and that the zoning will revert to R-E (Residential-Recreation).

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, February 17, 1999, and posted on February 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 8, 1999, RESCINDED BOS Resolution No. 94-213 and Resolution P&ZC: 84-160 and
REVERTED the zoning to R-E (Residential-Recreation), as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
