RESOLUTION NO. 99-84
A RESOLUTION SETTING FORTH AN ABANDONMENT OF MCCRACKEN MINE ROAD, A
COUNTY HIGHWAY, BEGINNING AT THE INTERSECTION OF PLANET RANCH ROAD
NEAR THE SOUTHEAST CORNER OF SECTION 5~ TOWNSHIP 14 NORTH, RANGE 15 WEST,
AND EXTENDING NORTHWESTERLY THROUGH VARIOUS SECTIONS IN TOWNSHIP 15
NORTH, RANGE 15 WEST TO THE ENDING POINT INTERSECTING WITH ALAMO ROAD
NEAR THE SOUTH QUARTER CORNER OF SECTION 1, TOWNSHIP 15 NORTH, RANGE 16
WEST, IN THE DUTCH FLAT PORTION OF THE MOHAVE COUNTY GENERAL AREA,
MOHAVE COUNTY~ ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8,
1999, a public hearing was conducted to determine ;vhether an Abandomnent should be granted for the
above-described county highway as requested by the Legend Land Company, L.L.C., represented by Ben
F. Brooks, II, Phoenix, Arizona, and
WHEREAS, the begim~ing point of the highway is located approximately 25 miles southeast of the
Yucca Townsite and southwesterly of Alamo Road. The site is accessed from Interstate 40 via the Alamo
Road Exit to the east side of Interstate 40, then south, east, and southeast on Alamo Road approximately
27.2 miles to Planet Ranch Road, then southwest on Planet Ranch Road, aka "Refrigerator Road," a 60-foot
ingress and Egress (I&E) easement, through Bureau of Land Management (BLM) property, for
approximately two miles to its intersection with the county highway, McCracken Mine Road. The county
highway extends approximately 6 miles, both northerly and southerly from this intersection point. The
southem extension of the highway provides access to public land, holdings by Legend Land Company, the
ASARCO Mining Co., the Marley Cattle Company, and at least 27 individual private holdings in Section
11, just beyond the southern terminus of the highway. This section of the high;vay is in moderate to good
condition and may be traversed with a conventional automobile. The northern extension provides access
to public land and Legend Land Company holdings only. This section of the highway is in moderate to poor
condition with overgrowth covering the last 5 miles of the aligmnent to its intersection with Alamo Road,

WHEREAS, the owner requests the county highway abandonment to allow for new 40-acre parcels
created by the Legend Land Company. The General Plan specifies that the land accessed by the highway
is in a Rural Development Area. Pending a land exchange of some 70,000 acres in Mohave County between
the BLM and Ben Brooks and Associates, a portion of the alignment in Township 14 North, Range 15 West
may enter public domain while the portion in Township 15 North, Range 15 West and Township 15 North,
Range 16 West may become privately owned, and

WHEREAS, Citizens Utilities Company has reviewed the owner's petition and has no objection to
the county highway abandonment, and
WHEREAS, the Bureau of Land Management has reviewed the agreement drafted by the Mohave
County Attorney's Office between the Mohave County Board of Supervisors and the property owners and
have no additional comments on the county highway abandomnent, and
WHEREAS, the Mohave County Department of Public Works has reviewed the owner's petition
and the agreement drafted by the Mohave County Attorney's Office between the Mohave County Board of
Supervisors and the property owners and has no objection to the county highway abandonment, and
WHEREAS, a review of FEMA FIRM Panels #040058-3025B indicates the highway described to
cross Zone D; FEMA FIRM Panel not in print, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All uotices have been advertised and posted according to regulations.
b. The site serves as the historic route to the McCracken Mine established in 1874.
c. The highway is not maintained by Mohave County, with the northern 5 miles of the roadway
overgrown by desert scrub.
d. The site has legal access.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 10, 1999, the Commission recommended APPROVAL for the Abandonment subject to the
following:
1. An agreement per the Mohave County Attorney's Office between the Mohave County Board
of Supervisors and the property owners will be signed before the roadway is abandoned.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
cimulation in Kingman, Mohave County, Arizona, February 17, 1999, and February 24, 1999, and posted
February 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
o 8, 1999, APPROVED this Abandonment as recommended by the Mohave County
herein.
