~,c?0~4-2C~ BK 3262 F% S85 /~.~.~.~;c:'?~_-~ OFFICIAL RECORDS OF MOHAVE COUNTY~ AZ ~: ~;..' ~:;~v~ JOAN ~C CALL, MOHA~E COUNTY oFRECOF'DER2 MOHA~E COUNTY BOARO OF SUPERVISORS RESOLUTION NO. 99-85 A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE NORTHERN 15 FEET OF THE 50-FOOT ROADWAY EASEMENT KNOWN AS RUTHIE AVENUE ADJOINING PARCEL 243, STOCKTON HILL RANCHES, UNIT 8, IN SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 8, 1999, a public hearing was conducted to determine whether approval should be granted to Abandon the above-described roadway easement as requested by Harvey and Jeanne Millermon of Kingman, Arizona, and WHEREAS, the site is located north of Kingman and approximately three-quarter mile east of Stockton Hill Road. The site is accessed from Stockton Hill Road via east on Jane Avenue to Parker Street, then north on Parker Street to its intersection with Ruthie Avenue. The easement extends eastward along Ruthie Avenue for approximately one-quarter mile. Two po~ver poles are placed within the easement. The surrounding land uses consist of vacant parcels and several single-family residences, and WHEREAS, the abandonment will allow a future fence to align with the existing fence on nearby parcels, and WHEREAS, the Mohave County Department of Public Works does not object to the abando~[nent of this 15-foot portion of the roadway easement provided a drainage easement is granted in its place and the remaining 35-foot portion of Ruthie Avenue be dedicated to the public as a roadway right-of-way. This may be accomplished xvith separate granting and dedication instruments. It was noted on the adjoining properties that other property perimeter roadway easements were similarly reduced in width. Parker Street and Longee Street along this property perimeter could be reduced with the same separate instruments, complete ~vith 20- foot radius curves at the right-of-way intersections, and WHEREAS, Citizens Utilities Company has reviewed the owner's petition and have no objection to the roadway abandonment, and WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave Count)' General Plan and the Long Mountain Area Plan. The site has legal access. e. There are no significant environmental features affecting the site· WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 10, 1999, the Commission recommended APPROVAL for the Abandomnent subject to the following: 1. The northern 15 feet of the 50-foot roadway easement known as Ruthie Avenue adjoining Parcel 243, STOCKTON HILL RANCHES, Unit 8, ~vill be granted to the public as a drainage easement and the remaining southern 35 feet of Ruthie Avenue will be dedicated to the public as a roadway right-of-way. This may be accomplished with a separate instrument. 2. Written concurrence from all affected utility companies must be obtained by the applicant and submitted to the Planning and Zoning Department. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 17, 1999, and February 24, 1999, and posted February 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations· NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 8, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
