RESOLUTION NO. 99-86
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE NORTHERN 20 FEET OF
THE 50-FOOT INGRESS/EGRESS EASEMENT KNOWN AS DELORIS AVENUE AND THE
WESTERN :10 FEET OF THE 50-FOOT INGRESS/EGRESS EASEMENT KNOWN AS
BANNISTER STREET ADJOINING PARCEL 248-C~ STOCKTON HILL RANCHES, UNIT 8, IN
SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, IN THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March ~,
1999, a public hearing was conducted to determine whether approval should be granted to Abandon the
above-described roadway easement as requested by James Ellery and Jennifer French of Kingman, Arizona,
and.
WHEREAS, the site is located north of Kingman and approximately one-quarter mile east of
Stockton Hill Road. The site is accessed from Stockton Hill P, oad via east on Jane Avenue to Bannister
Street, then north on Bannister Street to its intersection with Deloris Avenue. The easement extends
westward along Deloris Avenue for approximately 600 feet and northward along Bannister Street for
approximately 380 feet. Two power poles are placed within the easement along Bannister Street. The
surrounding land uses consist of vacant parcels and several single-family residences, and
WHEREAS, the abandonment ':,'ill allow a future fence to align with the existing fence on the
adjoining parcel, and
WHEREAS, the Mohave Cotmty Department of Public Works does not object to the abandonment
of the 20-foot portions of these roadway easements provided drainage easements are granted in their place,
and
WHEREAS, Citizens Utilities Company has reviewed the owner's petition and have no objection
to the roadway abandornnent, and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the Long
Mountain Area Plan.

c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant enviromnental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Conmfission on
February 10, 1999, the Commission recommended APPROVAL for the Abandonment subject to the
following:
1. The northern 20 feet of the 50-foot Ingress/Egress easement known as Deloris Avenue and
the western 20 feet of the 50-foot Ingress/Egress easement known as Bannister Street
adjoining Parcel 248-C, STOCKTON HILL RANCHES, Unit 8, will be granted to the public
as drainage easements. This may be accomplished with a separate instrument.
2. Written concurrence from all affected utility companies must be obtained by the applicant
and submitted to the Planning and Zoning Department.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
cimulation in Kingman, Mohave County, Arizona, February 17, 1999, and February 24, 1999, and posted
February 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 8, 1999, APPROVED this Abandomnent as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
