RESOLUTION NO. 99-97
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE NW¼
SW¼ OF SECTION 4 AND A PORTION OF THE NE¼ SE¼ OF SECTION 5, LYING
NORTHERLY OF INTERSTATE 15 AND EASTERLY OF COUNTY HIGHWAY 91, IN
TOWNSHIP 40 NORTH, RANGE 15 WEST, FOR A MOBILE HOME AS A SALES OFFICE IN
AN A (GENERAL) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by D. Kevin Hyde, representing Frontier Homes of Beaver Darn,
Arizona, and
WHEREAS, this property is located northeast of Interstate 15 and east of County Highway 91. The
site is accessed from Interstate 15 via north at the Interstate 15/County Highway 91 intersection to the
property, located on the east side of County Highway 91 just north of Interstate 15. The property is vacant
and the terrain is relatively flat, sloping slightly to the east toward the Virgin River. The surrounding land
uses consist of vacant lots, a golf resort and recreational vehicle park to the north. There are no significant
drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a mobile home as a sales office in
an A (General) zone. The Mohave County General Plan designates this area as an Urban Development Area.
The Virgin Rivers Cornmmfities Area Plan designates this area as a Medimn Density Residential Area, and
WHEREAS, a reviexv of FEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area. Additional comment: A plot plan is required as a portion of
this parcel is in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the Arizona Department of Transportation (ADOT) limits access to the existing access
road. There will not be any access granted to any part of Interstate 15, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan and the
Virgin Rivers Communities Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The neighboring area contains other like land uses similar to the above-proposed action.
The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is 1hr a mobile home as a sales office in an A (General) zone and
activities related thereto.
2. The appropriate access permits will be obtained from the Mohave County Public Works
Department prior to any development.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits and before establishing the use.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced wit.bin one ),ear of Board approval of the Zoning
Use Permit or if the use has been discontinued fbr six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
