JOAN MC CALL, MOHAVE COUNI'Y RECORDER MQHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 99-99 A RESOLUTION SETTING FORTH A REZONE OF THE SOUTH 150 FEET OF THE S¼ SW¼ SW~A SW¼ OF SECTION 21, EXCLUDING THE SOUTH 50 FEET AND THE EAST 250 FEET, LYING EASTERLY OF LONDON BRIDGE ROAD (OLD STATE HIGHVCAY 95), IN TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM C-2 (GENERAL COMMERCIAL) ZONE TO C-M (COMMERCIAL-MANUFACTURING) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Charles A. and Joyce M. Lund of Lake Havasu City, Arizona, and WHEREAS, this property is located east side of London Bridge Road, between Lake Drive and the Lake Havasu City Limits. The site is accessed from State Highway 95 via west on Lake Drive to London Bridge Road, then south on London Bridge Road to the site located on the east side, approximately 100 feet north of the city limits of Lake Havasu City. The property has a warehouse building on it and the terrain is relatively flat, sloping slightly to the southwest toward the Colorado River. The surrounding land uses consist of vacant land, several commercial business along both sides of London Bridge Road and a mobile home park to the east and northeast. Citizens Utilities, Water Division, has a water tank to the east of this property. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for expansion of the existing warehouse and for the purpose of selling the property for possible manufacturing. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-3110B indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. £ There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. PA6E 2 OF 2 BK.. ,..'?':'*>'t~ ,_, F'6 37 FEE¢99k')20634 RESOLUTION NO. 99-99 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-M (Commercial-Manufacturing). There will not be any outside storage allowed. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 5. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Atmotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a ne~vspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as required by Arizona Revised Statutes m~d the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning and outlined herein. .~- MO~ERVISORS , ..... ~ _2. ~=- : ,:;., Jantes h
