RESOLUTION NO. 99-101
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR
THE COMPLETION OF IMPROVEMENTS FOR SUN VALLEY, TRACT 4064-A, BEING A
SUBDIVISION OF A PORTION OF THE NE'¼ OF SECTION 1, TOWNSHIP 18 NORTH, RANGE
22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether an Extension of Time should be granted for the
assurances for the completion of all improvements for the above-referenced subdivision. The developer of
the subdivision is John McCormick, McCormick Development Corporation, Bullhead City, Arizona. The
project engineer for the processing of the completion of improvements for this subdivision is Anderson
Nelson, Inc., Bullhead City, Arizona, and
WHEREAS, the Final Plat of Sun Valley, Tract 4064-A, was recorded on February 27, 1992.
Following the recordation of Phase A of this tract, additional phases remained outstanding, requiring
Extensions of Time of the conditional approval of the Preliminary Plan. Extensions of Time for the
assurance for the improvements for this subdivision were implied included in the mmual extensions obtained
by the developer for the conditional approval of the Preliminary Plan for Sun Valley, Tract 4064, and
WHEREAS, the first separate Extension of Time for this assurance was granted on June 1, 1998,
per BOS Resolution No. 98-201. That extension expires May 1, 1999. Article 5.4 o£the Mohave County
Subdivision Regulations states: "The duration of the performance bond or other assurance shall be for one
(1) year from the date of recording. Extensions of Time in one (1) year increments may be granted by the
Board of Supervisors by showing just cause.", and
WHEREAS, the outstanding assurance balance as of the latest partial release dated February 8,
1996, is $208,493.03, and
WHEREAS, since the last extension for this assurance, the developer has submitted as-built
improvement plans, requesting the release of the remaining assurances for the subdivision. Review
comments from the Public Works Department have yet to be addressed by the project engineer, and
accordingly a release of the assurances is not ready at this time. The developer appears to be making
progress toward the completion of the improvements required for the subdivision, and
WHEREAS, the Public Works Department has commented that the project engineer must submit
a progress report, including the amount of improvements completed, the amount of improvements
remaining, and an expected date of completion of the improvements, and

WHEREAS, this action, if approved, will be the second Extension of Time for this assurance, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission reconnnended APPROVAL of the Extension of Time for the assurances
for the completion of subdivision improvements for Sun Valley, Tract 4064-A, subject to the following:
1. The developer shall, within 90 days of the date of Board approval of this extension, submit to the
Public Works Department a progress report prepared by the project engineer, including a description
of the amount of improvements completed in the subdivision, the amount of improvements
remaining, and an expected date of completion of the improvements.
2. This Extension of Time will be in effect until May 1, 2000.
WHEREAS, the advertising requirements have been met throughout this subdivision process as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 5, 1999, APPROVED this Extension of Time for the assurances for the completion of
subdivision improvements for Sun Valley, Tract 4064-A, as recommended by the Mohave County Planning
and outlined herein.
