RESOLUTION NO. 99-103
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE NE¼
SW¼ OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE SUBDIVIDED AND
KNOWN AS LOT 17, BLOCK A, DESERT HORIZONS, TRACT 4161, FOR A MODEL HOME IN
AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA,
MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by John K. Hoover, representing Counsel Corporation of Newpor~
Beach, California, and
WHEREAS, this property is located east of State Highway 95, between Camp Mohave Road and
E1 Rodeo Boa& The site is accessed £rom State Highway 95 via east on Aztec Road to Castilla Drive, then
south on Castilla Drive to the site, located on the southwest corner o£ Baronsgate Way and Castilla Drive.
The property is vacant and relatively fiat, sloping slightly to the west toward the Colorado River. The
surrounding land uses consist of vacant lots and single-fanfily residences. There are no significant drainage
patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a model home in an
(Agricultural-Residential) zone on a portion of the NE¼ SW¼ of Section 23, Township 19 North, Range
22 West, to be subdivided and known as Lot 17, Block A, DESERT HORIZONS, Tract 4161, to he zoned
R-O (Single Family Residential/MoNle Homes Prohibited) effective upon final plat recordation. The
Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FI~M Panel #040058-2445C indicates the parcel described to be
in Zone AG, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of' Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
£, There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area,

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Cornmission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a model home in an A-R (Agricultural-Residential) zone on
a portion of the NE¼ SW¼ of Section 23, Township 19 North, Range 22 West, to be
subdivided and known as Lot 17, Block A, DESERT HORIZONS, Tract 4161, to be zoned
R-O (Single Family Residential/Mobile Homes Prohibited) effective upon final plat
recordation and activities related thereto, including the selling of homes ;vithin the proposed
DESERT HORIZONS, Tract 4161, subdivision. No off-site sales will be allowed.
2. The house will be fully functional. When it is no longer being used as a sales office and
model home, it will be reconfigured to a single-family residence with garage and will be
inspected by the Mohave County Building Department for compliance with the building
code.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
, April 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Commission and outlined herein.
