RESOLUTION NO. 99-104
A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NO. 90-350
WHICH APPROVED THE REZONE OF THE W~ SW¼ OF SECTION 24, TOWNSHIP 19
NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, m the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether approval should be granted for the Rescission
of the Resolution for the Rezone of the above-described property as requested by the Mohave County
Planning and Zoning Department. The property owners ofreeord are Robert C. and Anita M. Rossberg of
Los Angeles, California, and
WHEREAS, this property is located east of State Highway 95, between E1 Rodeo Road and Camp
Mohave Road. The site is accessed from State Highway 95 via east on E1 Rodeo Road to the site, located
on the northeast comer of E1 Rodeo Road and Mountain View Road. The property is vacant and the terrain
is gently rolling hills generally rising to the northeast. There are no significant drainage patterns, and
WHEREAS, this property was conditionally approved for a rezone from A-R (Agricultural-
Residential) to R-O/6M (Single Family Residential/Mobile Homes Prohibited/Six Thousand Square Foot
Minimum Lot Size) and C-1/3A (Neighborhood Commercial/Three Acre Minimum Lot Size) by the
Mohave County Board of Supervisors on December 3, 1990, via BOS Resolution No. 90-350. The rezone
was in conjunction with MESA VISTA, Tract 4117, subdivision which has never been developed. The
applicant is in the process of applying for a new subdivision and rezoning proposal. A certified letter was
sent informing the property owner that it would be scheduled for rescission. The Mohave County General
Plan designates this area as an Urban Development Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site has legal access.
d. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission recommended that BOS Resolution No. 90-350 be RESCINDED and that
the zoning will revert to A-R (Agricultural-Residential).

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 5, 1999, RESCiNDED BOS Resolution No. 90-350 and REVERTED the zoning to A-R
(Agricultural-Residential), as recommended by the Mohave County Planning and Zoning Commission and
outlined herein.
