RESOLUTION NO. 99-106
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE S½
OF PARCEL 68, IN SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/10A
(AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/4A
(AGRICULTURAL-RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE
GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above-described property as requested by Ralph L. Husbeck of San Manuel, Arizona, and
WHEREAS, this property is located south of State Highway 68, between Teddy Roosevelt Road
and Colorado Road. The site is accessed from Highway 68 via south on Colorado Road to the property at
the northwest comer of Redwall Drive and Colorado Road. The property is vacant and relatively flat,
sloping slightly to the southeast. The surrounding land use consists of vacant land. There are no significant
drainage patterns that cross the property, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on December 4, 1995 via BOS Resolution No. 95-482. Due to Mr. Husbeck moving to San Manuel,
Arizona from Laughlin, Nevada, he did not receive any of the notification letlers informing him that he
needed an Extension of Time of his rezone, and
WHEREAS, this Extension of Time will allow the applicant time to complete the survey and the
required parcel plat and the other conditions as required by BOS Resolution No. 95-482, as stated in his
letter dated January 19, 1999, and
WHEREAS, the property owner has not accomplished any of the conditions of approval as required
by BOS Resolution No. 95-482, and
WHEREAS, this will be the first, second and third Extension of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and efi'ect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
g. This request complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Compliance with the conditions of BOS Resolution No. 95-482.
2. This Extension of Time ~vill be in effect until December 4, 1999.
3. Tt~is will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution No. 95-482.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 5, 1999, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
