HomeMy WebLinkAbout99-109 99L-12064,-~ BY, 3280 PG 60 OFFI{:IAL RECORDS OF MOHAVE COUNTY, AZ JOAN MC (:ALL, MOHAVE (:OUNTY RECORDER 04/0~/1999 11:55A PAGE I OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 99-109 A RESOLUTION SETTING FORTH A REZONE OF LOT 29-1, AS SHOWN ON RECORD OF SURVEY BOOK 17, PAGE 46, 1N THE E½ SE¼ OF SECTION 9, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE), A-R (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM PARCEL SIZE), AND C-2 (GENERAL COMMERCIAL) ZONES, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Terri Demaio, Golden Valley, Arizona, and WHEREAS, this property is located south of State Highway 68 on the west side of Adobe Road. The site is accessed from State Highway 68 via south on Adobe Road to the property, which is located on the northwest comer of Adobe Road and Shipp Drive. The property is vacant and the terrain is relatively flat, sloping slightly toward the south. The surrounding land uses consist of vacant parcels. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for commercial and residential development. The applicant proposes to divide the 10.1-net-acre parcel into one 2-net-acm parcel and three 1-net-acre parcels, all for residential development, and one 5-net-acre parcel for commercial development. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Ama. Additional cozmnent from Mohave County Floodplain: A plot plan is required, as a portion of the parcel is in Zone C, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Sacramento Valley/Golden Valley Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above-proposed action. There are no significant environmental features affecting the site, except the Special Flood Hazard Area noted above. g. The property has water, electric, and telephone service, and is in compliance with Policy and Procedure Memorandum 97-3, Minor Land Divisions. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The southern proposed parcel will be rezoned A-R/2A (Agricultural-Residential/Two Acre Minimum Parcel Size). The central three proposed parcels will be rezoned A-R (Agricultural-Residential/One Acre Minimum Parcel Size), and the northern proposed parcel will be rezoned C-2 (General Commercial). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Upon development, Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits for the proposed parcel to be rezoned C-2 (General Commercial). 3. The Mohave County Public Works Department recommends that a 20-foot radius curve shall be dedicated to Mohave County as roadway right-of-way at the intersection of Adobe Road and Shipp Drive. 4. A view-obscuring fence shall separate all residential and non-residential uses. 5. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 6. All rights-of-way dedicated on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 7. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 8. Each parcel shall have legal access. 9. The applicable flood zone(s) shall be noted on the Parcel Plat. 10. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 11. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. PAGE 3 OF 3 BK 3280 PG 62 FEE.~99020644 RESOLUTION NO. 99-109 Page 3 12. if the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public heating to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
