RESOLUTION NO. 99-117
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF PARADISE TRAILS, TRACT 3802, BEING A
SUBDIVISION OF THE PORTION OF SECTION 25, TOWNSHIP 18 NORTH, RANGE 18 WEST,
LYING WEST OF THE INTERSTATE 40 RIGHT-OF-WAY, IN THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to detemaine whether approval should be granted for an Extension of
Time as requested by Todd Bremner, partner and engineer for the developer, Rubal Ruther, Double R
Development, Lake Havasu City, Arizona, and
WHEREAS, the property is located approximately 17 miles south of the City of Kingman and t~vo
miles north of the Yucca townsite. The sire is accessed via the Old Trails interchange of Interstate 40 and
lies immediately west of the highway right-of-way, and
WHEREAS, this Preliminary Plan depicts 149 acres subdivided into 94 residential lots and 16
commercial lots. The residential lots range in size from one-half acre to one and one-half acres. The
co~mnercial lots range in size from one acre to slightly more than seven acres. The subdivision also includes
a drainage parcel and a parcel for a well site, and
WHEREAS, the developer has in the past several months discussed with Mohave County the
possible removal of several large commercial lots in the northeast portion of the subdivision from the tract
boundary, in an attempt to postpone the required paved construction of a segment of roadway required as
a condition of the Preliminary Plan approval. The developer is considering processing those tentatively
commercial parcels separately from the subdivision. However, as no formal and definitive proposal for such
changes has been presented by the developer to Planning and Zoning, no review has been made and no
agreements have been issued which would at this time alter in any ;vay the existing conditionally approved
Preliminary Plan for Paradise Trails, Tract 3802, nor the terms of that plat approval, and
WHEREAS, the developer has indicated in an undated letter that an Extension of Time is being
requested, as the developer needs additional time to decide if he will propose the changes discussed above,
and time to submit redrawn plats in that event, and for the general processing of the project. Currently, the
subdivision is not being phased. The first Final Plat submittal for this subdivision was completed for review
in August, 1998, over three years after the Preliminary Plan approval for the tract, and

WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on May 1, 1995, per BOS Resolution No. 95-193. The first Extension of Time of the
conditional approval of the Preliminary Plan for this tract was granted on June 2, 1997, per BOS Resolution
No. 97-188, expiring on May 1, 1998. The second extension was granted on June 1, 1998, per BOS
Resolution No. 98-208, with project approval automatically expiring on May 1, 1999. Subdivision
Regulations, Article 3.10~ 1 states: "Upon application to the Commission and prior to the expiration of the
time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the
subdivider is actively processing the Final Plat. If such action is not taken then ail proceedings relating to
the plat shall be terminated.", and
WHEREAS, since the last Extension of Time, this subdivision has progressed due to the recent
submittal and partial processing of a Final Plat for the subdivision. The extent of changes being considered
by the developer for this project may- jeopardize current approvals and require the submittal of a new
Preliminary Plan and rezone application. Such plat changes have only been discussed at this time and are
not certain to occur. Staff recommends conditional approval of this request for an extension of the
conditional approval of the existing Preliminary Plan for Paradise Trails, Tract 3802, based on recent plat
activity, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have recon-nnended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this action, if approved, will be the third Extension of Time for the conditional
Preliminary Plan approval of this proposed subdivision, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request appears to comply with the intent of the Extension of Time Policy, due largely
to the recent submittal and processing of a Final Plat for this subdivision.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 95-193, 97-188, and 98-208.
2. This Extension of Time will be in effect until May 1, 2000.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes and the Mohave Cotmty Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 5, 1999, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Co~nmission and outlined herein.
