WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above- described property as requested by Jan Negri, C.S.N.A. Surveying, Kingman, Arizona, representing D.B. & Phyllis Haley, Kingman, Arizona, and WHEREAS, this property is located south of Interstate 40 and east of Hackberry Road. The site is accessed from U.S. Highway 93 via northeasterly on Hackberry Road approximately four and one-half miles to an unnamed Ingress & Egress (I&E) easement located approximately one-quarter-mile south of Interstate 40, then east on the unnmned I&E easement approximately one-quarter-mile to the southwestern corner of the property. The property is vacant and the terrain is rolling hills. The surrounding land uses consist of vacant parcels. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for development. The applicant proposes to divide the 39.77-gross-acre parcel into four approximately 5-net-acre parcels, and one 15.74-net- acre parcel. The Mohave County General Plan designates this area as Suburban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2400B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area DOES NOT contain land uses similar to the above-proposed action. e. The site has legal access. £ There are no significant environmental features affecting the site. F'~fiE 2 OF 2 BY, 7280 F'6 88 FEE~99020554 RESOLUTION NO. 99-119 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1999, the Commission recommended DENIAL for a Rezone based upon the following: 1. The approval of this request for a Rezone would violate Policy and Procedure Memorandum 97-3, as such approval would set a precedent for creation of significantly higher densities in the area; and the area does not contain similar land use densities. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
