HomeMy WebLinkAbout99-125 99020660 BK 3281] F'G [04 OFFICIAL RECORDS OF MOHAYE COUNTY~ AZ JOAN MC (:ALL, MOHAVE COUNTY RE(ORDER 04/07/1999 11:59A PAGE 1 OF 2 MOHAVE COUNTY BOAR[) OF SUPERVISORS RECORDING FEE RESOLUTION NO. 99-125 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL D OF LAST LAP SUBDIVISION, TRACT 3807, AS SHOWN ON PARCEL 31-B OF RECORD OF SURVEY BOOK 15, PAGE 87, IN SECTION 31, TOWNSHIP 15 NORTH, RANGE 17 WEST, FOR A WATER STORAGE TANK IN A M-X (HEAVY MANUFACTURING) ZONE, IN THE YUCCA PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Randy Lyles of Temecula, California, being represented by Moha,'e Engineering Associates, inc., of Kingman, Arizona, and WHEREAS, this property is located south of Alamo Road and southeast of Interstate 40 in the Yucca area. The site is accessed from Interstate 40 via the Alamo Road Exit, to the east side Interstate 40, then south and southeast on Alamo Road approximately 22.2 miles to Rawhide Road, then south approximately four-tenths (0.4) mile on Rawhide Road to Creosote Drive, then ~vest on Creosote Drive approximately nine (9) miles to Dale Evans Road, then south on Dale Evans Road to Cholla Drive, then west on Cholla Drive to Butch Cassidy Road, then south on Butch Cassidy Road to Juniper Drive, then west on Juniper Drive to Wild Bill Road, then south on Wild Bill Road to Mesquite Drive, then west on Mesquite Drive to Cochise Road, then south on Cochise Road to Apache Road, then *vest on Apache Road approximately one-half (~/2) mile to the northeast corner of the site. The property is vacant and relatively fiat, sloping slightly to the northeast. The surrounding land uses consist of vacant (BLM) and railroad land. There are several significant drainage patterns crossing the property from the southwest to the northeast, and WHEREAS, the applicant requests this Zoning Use Permit for a*vater storage tank in a M-X (Heavy Manufacturing) zone. The Mohave County General Plan designates this area as a Rural Development Area, mad WHEREAS, a review of FEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional comments from the Mohave Cmmty Flood Control District: There are washes crossing this parcel - DO NOT BLOCK, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The above action is part of the proposed subdivision to support the required water system. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave Count), Planning and Zoning Commission on March 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a water storage tank on Parcel D of LAST LAP SUBDIVISION, Tract 3807, in a M-X (Heavy Manufacturing) zone and activities related thereto. 2. The Arizona Department of Water Resources (ADWR) and Arizona Department of Environmental Quality (ADEQ) shall approve the proposed for two water systems on the same subdivision. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. The tank shall be painted an earth tone color. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. BE IT RESOLVED, that the Board of Supervisors, at their regular meeting APPROVED this Zoning Use Permit as recommended by the Mohave Cotmty MOHAV~ERVISORS
