SETTING FORTH A REZONE OF PARCEL 31-B AS SHOWN ON RECORD OF SURVEY BOOK

(HEAVY MANUFACTURING) ZONE, IN THE YUCCA PORTION OF THE MOHAVE COUNTY
GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
1999, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 97-401,
setting forth a Rezone, should be granted for the above-described property as requested by Randy Lyles of
Temecula, California, being represented by Mohave Engineering Associates, Inc., of Kingman, Arizona, and
WHEREAS, the language to be added has been boided or bolded and double underlined.
Language to be deleted has been struck, and
WHEREAS, this property is located south of Alamo Road and southeast of Interstate 40 in the
Yucca area. The site is accessed from Interstate 40 via the Alamo Road Exit, to the east side Interstate 40,

approximately 22.2 miles to Rawhide Road, then south approximately four-tenths (0.4) mile on
Rawhide Road to Creosote Drive, then west on Creosote Drive approximately nine (9) miles to Dale
Evans Road, then south on Dale Evans Road to Cholla Drive, then west on Cholla Drive to Butch
Cassidy Road, then south on Butch Cassidy Road to Juniper Drive, then west on Juniper Drive to
Wild Bill Road, then south on Wild Bill Road to Mesquite Drive, then west on Mesquite Drive to
Cochise Road, then south on Cochise Road to Apache Road, then west on Apache Road approximately
one-half (½) mile to the northeast corner of the site. The property is vacant and relatively flat, sloping
slightly to the northeast. The surrounding land uses consist of vacant (BLM) and railroad land. There are
several significant drainage patterns crossing the property from the southwest to the northeast, and
WHEREAS,the applicant requests this Amendment to BOS Resolution No. 97-401, approving
a Rezone, to correct the legal description for the property as Parcel 31-B is larger than the SW¼ of
Section 31; to remove the condition for the requirement of a Site Plan, as the applicant is now creating
a subdivision; to remove the condition for the requirement of a Specific Use Permit, as it is no longer
required in M-X (Heavy Manufacturing) zoning; and to add the requirements for the subdivision to
the Conditions of Approval, and

WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-3000B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area; Additional comments from the Mohave County
Flood Control District: There are washes crossing this parcel - DO NOT BLOCK, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 10, 1999, the Commission recommended APPROVAL of the proposed Amendment to BOS
Resolution No. 97-401, setting forth a Rezone, subject to the following:
1. This property will be rezoned M-X (Heavy Manufacturing).
2. All residential uses in M-X (Heavy Manufacturing) zoning require a Zoning Use Permit.
4: 3. ']7he applicant shall comply with all applicable provisions of the Mohave County Zoning
~ 4. The applicant shall provide permanent access to this property.
5. The rezone will be effective upon the recordation of the Final Plat of LAST LAP
SUBDIVISION, Tract 3807, or for each phase of LAST LAP SUBDIVISION, Tract
3807, if the subdivision is phased and the rezone shall not become effective until at least
30 days after f'mal approval of the change in classification by the Board of Supervisors,
as per ARS 11-829E.
6. The lot size minimum will be based on the size of the lots recorded on the Final Plat
with no further lot splits.

7. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
WHEREAS, the notice of hearing was published in The Standmd, a newspaper of general
circulation in Kingman, Mohave Co~ty, Arizona, March 17, 1999, and posted on March 19, 1999, as
required by Arizona Revised Statutes ~d the Mohave County Zoning Regulations.
NOW THE~FO~ BE IT ~SOLVED, ~at the Bo~d of Supe~isors, at their regulm- meeting
on Monday, April 5, 1999, APPROVED the Amendment to BOS Resolution No. 97-401, setting forth a
Rezone, as recommended by the Mohave Coun~ Planmng ~d Zomng Comm~ssmn ~d outlined herein.
