WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public he~ing was conducted to dete~ine whether an Amendment to BOS Resolution No. 97-402, setting fo~h a Zoning Use Pem~it, should be grated for the above-described prope~y as requested by R~dy Lyles of Temecula, California, being represented by Mohave Engineering Associates, Inc., of Kingman, Arizona, and WHE~AS, the language to be added has been bolded or bolded and double underlined. Language to be deleted has been~, ~,'~ ~d WHEREAS, this property is located south of Aline Road and southeast of Interstate 40 in the Yucca area. The site is accessed from Interstate 40 via the Al~o Road Exit, to the east side Interstate 40, ........ ~ ........... ~ .................... ....... then south and southeast on Alamo Road approximately 22.2 miles to Rawhide Road, then south approximately four-tenths (0.4) mile on Rawhide Road to Creosote Drive, then west on Creosote Drive approximately nine (9) miles to Dale Evans Road, then south on Dale Evans Road to Cholla Drive, then west on Cholla Drive to Butch Cassidy Road, then south on Butch Cassidy Road to Juniper Drive, then west on Juniper Drive to Wild Bill Road, then south on Wild Bill Road to Mesquite Drive, then west on Mesquite Drive to Cochise Road, then south on Cochise Road to Apache Road, then west on Apache Road approximately one-half (~) mile to the northeast corner of the site. The prope~y is vacant and relatively flat, sloping slightly to the no,beast. The su~ounding l~d uses consist of vacant (BLM) ~d railroad lined. There are several significant drainage patterns crossing the property from the southwest to the northeast, and WHE~AS, the applicants request this Amendment to BOS Resolution No. 97-402, approving a Zoning Use Permit, to correct the legal description for the prope~ as Parcel 31-B is larger than the SW% of Section 31 and to change the condominiums/shop complex to single-family residences, and PAGE 2 OF S RESOLUTION NO. 99-128 e,K 3280 1:'6 112 FEEf9902~63 rage WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-3000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional comments from the Mohave County Flood Control District: There are washes crossing this parcel - DO NOT BLOCK, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies ;vith the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Cmmnission on March 10, 1999, the Commission recommended APPROVAL of the proposed Amendment to BOS Resolution No. 97-402, setting forth a Zoning Use Permit, subject to the following: 1. This Zoning Use Permit is for a condominimm/ahc, p cc, mplcx single-family residences in an M-X (Heavy Manufacturing) zone and activities related thereto. 2. The Zoning Use Permit will commence upon the effective date of the rezone. 3. If construction or use has not commenced ;vithin two years of Board approval of the Zoning Use Pemfit or if the use has been discontinued for six months, then approval shall terminate at that date. 4. This Zoning Use Pemfit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. FEE~99L"~206,S,7, RESOLUTION NO. 99-128 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, APPROVED the Amendment to BOS Resolution No. 9%402, setting forth a Zoning Use Permit, as recommended by the Mohave County Planning and Zoning Commission amd outlined herein.
