WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Robert L. and Marilynn Bader of Meadview, Arizona, and WHEREAS, this property is located on the east side of Pierce Ferry Road, between Charles Drive and Smith Road, approximately eight and one-half (8~A) miles south of Meadview Boulevard. The site is accessed from U. S. Highway 93 via northeast and then north on Pierce Ferry Road to the site, located on the east side of Pierce Ferry Road approximately 500 feet north of Smith Road. The property is vacant and relatively flat, sloping slightly to the northeast. The surrounding land uses consist of vacant lots and a few single-family residences to the east, north and south and several general commemial buildings along Pierce Ferry Road. There is Bureau of Land Management (BLM) land across Pierce Ferry Road to the west. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2/1A (General Commercial/One Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-1450C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF' 2 BK 3281 F'G 115 FEE~9932r~6,~,4- RESOLUTION NO. 99-129 Page 2 WHEREAS, at the public hearing before the Mohave County Plarming and Zoning Conunission on March 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the J[bllowing: 1. This Zoning Use Permit is for a residence in a C-2/IA (General Commercial/One Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and posted on March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
