WHEREAS, at the regular meeting o£ the Mohave County Board of Supervisors held on April 5, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway as requested by Wayne and Sandra Smith, Rialto, California, and WHEREAS, this property is located east of Old US Highway 93, approximately five miles north;vest of the US Highway 93/Old US Highway 93 intersection. The site is approximately one-half mile north of Old US Highway 93 via Calle Marco, a dedicated roadway. The site is not readily accessible without a four-wheel drive vehicle. The right-of-way is unimproved and unused. The terrain's gently rolling to moderately steep hills slope generally toward the east. The surrounding land uses consist of vacant parcels with Arizona State Trust lands to the ;vest. The abandonment will increase the buildable area of the site, and WHEREAS, Mohave Electric Cooperative has reviewed the owner's petition and has no objection to the roadway abandomnent, and WHEREAS, Citizens Utilities Compmqy has reviewed the owner's petition and has no objection to the roadway abandonment, and WHEREAS, the Mohave County Department of Public Works does not object to the abandonment of the right-of-way, and WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. All effected utility companies in the area have been notified, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 10, 1999, the C0rmraission recommended APPROVAL for the Abandonment subject to the following: 1. The 60-foot right-of-way, beginning at the northeast corner of the SW¼ SW¼ of Section 1 and extending west 1,278.32 feet to an existing north-south running 42-foot right-of-way, in Section 1, Township 20 North, Range 14 West be abandoned. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1999, and March 24, 1999, and posted March 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 5, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
