MOHA~E COUNTY BOARO OF SUPERVISORS RECOROING FEE 0.00 RESOLUTION NO. 99-157 A RESOLUTION SETTING FORTH THE STERLING AREA PLAN CONSISTING OF SECTIONS 22, 23, 25, 26, 27, 34, AND 35 OF TOWNSHIP 16~ NORTH, RANGE 20½ WEST; SECTIONS 30, 32, AND PORTIONS OF SECTIONS 31 AND 33 OF TOWNSHIP 16M NORTH, RANGE 20 WEST; SECTIONS 1, 2, 3, 12, AND THOSE PORTIONS IN SECTIONS 10, 11, AND 13 OF TOWNSHIP 16 NORTH, RANGE 20¼ WEST; SECTION 6 AND THOSE PORTIONS OF SECTIONS 15, 17, 18 OF TOWNSHIP 16 NORTH, RANGE 20 WEST; AND THOSE PORTIONS OF SECTION 18 OF TOWNSHIP 16 NORTH, RANGE 19 WEST, AS DEPICTED ON EXHIBIT A, IN THE TOPOCK- GOLDEN SHORES AREA OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on May 24, 1999, a public hearing was conducted to determine whether the Sterling Area Plan should be approved as requested by FMA International of Newport Beach, California, authorized agent for Topock Mesa, LTD. and Warm Springs Development, LTD., of Phoenix, Arizona, and WHEREAS, the Sterling Area Plan consists of approximately sixteen (16) square miles contained in portions of five (5) townships with a western boundary located one (1) mile east of the community of Golden Shores and two (2) miles east of the Topock Wilderness Area, with the southernmost portion following the Interstate 40 right-of-way aligmnent, and the northernmost boundary adjoining the south boundary of Township 17 North, Range 20 West, approximately twenty-three (23) miles north of Lake Havasu City and approximately twenty-five (25) miles south of Bullhead City near' the California border, and WHEREAS,the applicant is proposing this Area Plan to develop the described properties into eight (8) "Villages" through multiple phases consisting of single and nmlti-family residential housing, commercial-industrial enterprises, recreational facilities, parks, arterial and residential roads, water, sewer and electric service facilities, and other urban amenities eventually incorporating into a city comprising approximately 50,000 people at completion within the next twenty-five (25) years, and WHERAS, the area is low desert terrain consisting of rolling hills, washes and arroyos forming the rising pavilion of the Black Mountains to the east, with all drainage toward the Colorado River approximately three (3) miles west, and WHEREAS, three public meetings were held in Lake Havasu City and the Golden Shores community according to General Plan amendment procedures, including the general public, federal, state and local governmental agencies, public utilities and private enterprise, and RESOLUTION NO. 99-157 Page 2 WHEREAS, a review of FEMA FIRM Panel maps 040058-2825C, 2805C, and 2815C indicate the area consists of unstudied floodplain designation A Zones, areas of 100-year flood (base flood elevations and flood hazard factors not determined), and areas of minimal flooding Zone C, and WHEREAS, the following described Findings of Fact are relevant to the above-captioned item: a. Ali public notices and meetings have been held, advertised, and posted according to state law and county regulations. b. The proposed action and effect complies with the Mohave County General Plan. WHEREAS, at a public hearing on March 10, 1999, the Mohave County Planning and Zoning Commission recommended approval for this action subject to the following: 1. The Sterling Area Plan is designated Urban Development Area in the Mohave County General Plan and full urban development and services shall be required for any development, except for any area mdesignated to lesser requirements by mnendment to the General Plan and Sterling Area Plan. 2. Development within and throughout the Sterling Area Plan shall be in accordance with the Mohave Cotmty development and subdivision standards current at the time of any development, including any off-site improvement, conditional to any and all county approved developer agreements. 3. Mohave County is not obligated in any way, however described, to paxticipate in the financial or any other assistance of any portion of any development or improvement to the Sterling Area Plan property on or off-site. 4. The Addendum to the Sterling Area Plan~ dated February 5, 1999, as described by FMA International of Newport Beach, California, authorized agent for the owner, Topock Mesa Limited and Warm Springs Development of Phoenix, Arizona, is hereby included in the Sterling Area Plan by reference. 5. The Addendum to the Sterlin~ Ama Plan, dated March 5, 1999, as described by FMA International of Newport Beach, California, authorized agent for the owner, Topock Mesa Limited and Warm Springs Development of Phoenix, Arizona, is hereby included in the Sterling Area Plan by reference. 6. No out of sequence leap-frog type development (unconnected, disjointed development) proposed for any part of the Sterling Area Plan will be allowed or processed by the county unless and until the out of sequence development is within 1320 feet of and can be connected to the Sterling central infrastructure service system upon completion. Overall developer control and confirmation of trunk system infrastructure development will be ensured by the assignment of a Master Developer to oversee all phases of development in any pan of the Sterling Area Plan according to the Area Plan goals and policies. 8. Any proposed development in the Sterling Area Plan shall be able to stand on its own, independent of any other development, and shall be required to co~mect to any central infrastructure system if the development is within 1320 feet of that system when constructed or after construction when the central infrastructure system comes within 1320 feet. 9. Section 8.5. Subdivisions amd Site Plans, of the Sterling Area Plan, is hereby amended by amending the last sentence to read: "Until such alternative Standards and Details are adopted, deviations from the County typical Standards and Details may be proposed for consideration by the County on a Village by Village basis." 10. Section 8.6. Area Plan Amendments, of the Sterling Area Plan, is hereby amended by replacement with the following: "Any amendment to the Sterling Area Plan shall be in accordance with Mohave County General or Area Plan amendment requirements including Section 40.2 of the Mohave Connty Zoning Ordinance." 11. A "Master Facility and Central Infrastructure System Development Plan" shall be submitted to and approved by Mohave County before any "Developer's Agreement" for any portion, or all of the Sterling Area Plan area is signed by Mohave County. WltEREAS, notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 5, 1999, and posted on May 7, 1999, as required by Arizona Revised Statutes. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their special meeting on Monday, May 24, 1999, APPROVED the Sterling Area Plan as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
