HomeMy WebLinkAbout99-160 ~tlO~OflL~LO OFFICIAL RECOROS OF MOHAVE COUNTY,~ AZ JOAN MC CALL, HOHAVE COUNTY RECORDER HOHAVE COUNTY BOARD OF SUF'ERV]:SOPS RECORDING FEE 0.00 RESOLUTION NO. 99-160 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SW¼ NE¼ OF SECTION 36, TOWNSHIP 41 NORTH, RANGE 14 WEST, FOR A CELLULAR TELEPHONE COMMUNICATION FACILITY IN A R-E/10A (RESIDENTIAL-RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by GCC License Corporation of Bellevue, Washington, and WHEREAS, this property is located approximately three and one-half (3½) miles south-southeast of the Cedar Pocket Traffic Interchange and Rest Area on Interstate 15, between Sullivans Canyon and Purgatory Canyon, north of Black Rock Mountain. The site is accessed from Interstate 15 via Mesquite, Nevada, easterly on Elbow Canyon Road fo various unimproved roads through Bureau of Land Management (BLM) land to the site. The property is designated as a BLM Communication Site and has two other communication leases granted by the BLM on it. The surrounding land uses consist of vacant cattle grazing land managed by the BLM. The Paiute Wilderness Area is to the west and north. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a cellular telephone communication facility in a R-E/10A (Residential-Recreation/Ten Acre Minimum Lot Size) zone on Bureau of Land Management (BLM) land designated as a BLM Communication Site. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-0050B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PA6£ 2 OF ~ RESOLUTION NO. 99-160 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 14, 1999, the Commission reconmaended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a cellular telephone communication facility and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. A perpetual easement (minimum of 20 feet recommended) from the Bureau of Land Management (BLM) shall be established as legal access to this site. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. lifts Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 10, 1999, APPROVED this Zorfing Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
