WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10, 1999, a public heating was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by GCC License Corporation of Bellevue, Washington, and WHEREAS, this property is located north of Interstate 15, between the Virgin River and County Highway 91. The site is accessed from County Highway 91 via east on an unnamed common road, which begins irmnediately south of the Arizona Department of Transportation (ADOT) maintenance yard and meanders to the east, intersecting the southern boundary of Section 33 at its southeast comer. The proposed site is located within the SW¼ SW¼ of Section 33. The property is vacant with two water storage tanks on it. The terrain is relatively flat, generally sloping to the east toward the Virgin River. The surrounding land uses consist of vacant lots, single-family residences and the Cock-Fighting Arena to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a cellular telephone communication facility in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area. The Virgin River Communities Area Plan designates this area as a BLM/Trade/Lease/Purchase Area, and WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF 2 B~, L'iGOL PG 42°, FEE$C,'~02~527 RESOLUTION NO. 99-161 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 14, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a cellular telephone communication facility and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. A perpetual easement (minimum of 20 feet reconunended) from the Bureau of Land Management (BLM) shall be established as legal access to this site. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If constmction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission m~d Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 10, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
