RESOLUTION NO. 99-164
EVALUATION OF A REQUEST FOR AN EXTENSION OF TIMF, OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF DESERT LAKES ESTATES, TRACT 4152, BEING A
SUBDIVISION OF A PORTION OF THE SW¼ OF SECTION 36, TOWNSHIP 19 NORTH,
RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WItEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10,
1999, a public heating was conducted to determine whether approval should be granted for an Extension of
Time as requested by one of the developers, Angelo Rinaldi, Fort Mohave, Arizona, for the above-described
Preliminary Plan. The new project engineer is Phoenix Engineering, Inc., Phoenix, Arizona, and
WHEREAS, the property is located approximately three and one-half miles south of Bullhead City.
The property is accessed via State Highway 95, then east one mile along Lipan Boulevard, then north several
hundred feet along and east of Mountain View Road to the site, and
WHEREAS, this Preliminary Plan for Desert Lakes Estates, Tract 4152, depicts 80.5 acres
subdivided into 272 single-family residential lots and 14 drainage parcels. Residential lots range in size
from 8,000 to 9,260 square feet, and
WHEREAS, the developer has indicated in a letter dated March 1, 1999, that an Extension of Time
is being requested, as the developer needs time to process and record the Final Plats for the proposed phases
in the subdivision. Eight phases were proposed. Only one phase has yet been recorded, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on June 6, 1994, per BOS Resolution No. 94-170. The first and second Extensions of Time of
the conditional approval of the Preliminary Plan for this tract were granted on January 5, 1998, per BOS
Resolution No. 98-5, expiring on June 6, 1998. A third extension was granted on October 5, 1998, per BOS
Resolution No. 98-342, with project approval automatically expiring on June 6, 1999. Subdivision
Regulations, Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the
time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the
subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to
the plat shall be terminated.", and
WHEREAS, the Final Plat for Tract 4152-A, the first phase of this subdivision, was recorded
November 28, 1995. Improvements for Tract 4152-A remain to be completed, and

WItEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed. They have recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this action, if approved, will be the fourth Extension of Time for the conditional
Preliminary Plan approval of this proposed subdivision, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request complies with the Extension of Time Policy, as a first phase of this subdivision
is recorded, and as the developer has, since the last extension, submitted for review a Final
Plat for the second phase of the subdivision. The developer has, however, allowed
significant amounts of time to elapse between plat submittals.
WHEREAS, at the public hearing before the Mohave Cotmty Planning and Zoning Commission on
April 14, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 94-170, 98-5, and 98-342.
2. The developer must, prior to the expiration of this conditional approval, process the
submitted Final Plat for Tract 4152-B to recordation. Unless significant progress is made
in the coming year, including the recordation of the Final Plat for Tract 4152-B, Planning
staff will recommend denial of any additional Extensions of Time for this Preliminary Plan.
3. This Extension of Time will be in effect until June 6, 2000.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 10, 1999, APPROVED this Extension of Time as recommended by the Mohave County
Commission and outlined herein.
