F'G 4.40 OFFICIAL RECORDS OF MOHAVE COUNTY~ AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 05/12/19~9 02:46P PAGE I OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 99-166 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR THE COMPLETION OF IMPROVEMENTS FOR MESA VILLAS, TRACT 4146, BEING A SUBDIVISION OF A PORTION OF THE SW¼ OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10, 1999, a public hearing was conducted to determine whether an Extension of Time should be granted for the assurances for the completion of all improvements for the above-referenced subdivision. The developer of tiffs subdivision is Debra Grissom, Nortbaidge, California. The project engineer was Burton Engineering, Inc., a firm no longer doing business in the State of Arizona, and WHEREAS, the Final Plat of Mesa Villas, Tract 4t46, was recorded on June 19, 1995. The first and second Extensions of Time for this assurance were granted on February 2, 1998, per BOS Resolution No. 98-49. A third extension was granted on July 13, 1998, per BOS Resolution No. 98-237. That extension expires June 19, 1999. Article 5.4 of the Mohave County Subdivision Regulations states: "The duration of the performance bond or other assurance shall be for one (1) year from the date of recording. Extensions of Time in one (1) year increments may be granted by the Board of Supervisors by showing just cause.", and WHEREAS, since the last extension for this assurance, the developer has submitted no as-built improvement plans or other documents as evidence of the completion of any further subdivision improvements. The project engineer is no longer doing business in this state. Mohave County has not received any verification that an engineer is, in fact, still working for the developer toward the completion of improvements for this subdivision. The project appears to be making little progress toward the completion of improvements; however, in a recent phone conversation the developer advised staff that she is interested in completing the subdivision improvements within the next extension period, assuming an extension is granted, and WHEREAS, the outstanding assurance balance as of the latest partial release dated June 11, 1996, is $16,216.09, and WHEREAS, this will be the fourth Extension of Time for this assurance, and WHEREAS, the Public Works Department has commented that the project engineer must submit a progress report, including the amount of improvements completed, the mnount of improvements remaining, and an expected date of completion of the improvements, and RESOLUTION NO. 99-166 Page 2 WHEREAS, at the public hearing before the Mohave County Planning mad Zoning Commission on April 14, 1999, the Commission recommended APPROVAL of the Extension of Time for the assurances for the completion of subdivision improvements for Mesa Villas, Tract 4146, subject to the following: 1. The developer shall, within 90 days of the date of Board approval of this extension, submit to the Public Works Department a progress report prepared by the project engineer, including a description of the amount of improvements completed in the subdivision, the amount of improvements remaining, and an expected date of completion of the improvements. 2. This Extension of Time will be in effect until June 19, 2000. WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, i999, and posted on April 23, 1999, as required by Arizona Revised Statutes and the Mohave Couuty Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 10, 1999, APPROVED this Extension of Time for the assurances for the completion of subdivision improvements for Mesa Villas, Tract 4146, as reconunended by the Mohave County Planning and Zoning Commission and outlined herein.
