RESOLUTION NO. 99-170
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 4, BLOCK 2,
MOUNTAIN VIEW RANCHES, TRACT 4003-C, IN SECTION 5, TOWNSHIP 18 NORTH, RANGE
21 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/SA (AGRICULTURAL-RESIDENTIAL/
FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA,
MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10,
1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Wilber L. and Doris M. Horn of Valinda, California, and
WHEREAS, this property is located east of State Highway 95, on the south side of Boundary Cone
Road. The site is accessed from State Highway 95 via east on Boundary Cone Road to the site, located on
the south side of Boundary Cone Road between Ashley Street and Chauncey Boulevard. The property has
a single-family residence on it and the terrain is relatively flat, sloping slightly to the west toward the
Colorado River. The surrounding land uses consist of vacant lots, a few scattered single-family residences,
several general commercial businesses and a recreational vehicle park along both sides of Boundary Cone
Road to the east. There is a large wash crossing the south side of this property from the northeast to the
southwest, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-
R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) zone for family purposes. The Mohave
County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area and the wash crossing the south side of this property from the northeast
to the southwest.

WHEREAS, at the public heating before the Mohave County Plamfing and Zoning Commission on
April 14, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Pemfit is for a secondary residence on this property and the activities
related thereto. The floor area of the secondary residence shall comply with the size
requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per
the Mohave County Zoning Regulations, the secondary residence will be used for non-
paying guests and relatives ONLY.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan
in accordance with Section 27.R must be completed and approved prior to approval of
permits and before establishing the use.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Pemfit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 10, 1999, APPROVED tlfis Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
