RESOLUTION NO. 99-175
A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF PARCEL 235, AS SHOWN
ON RECORD OF SURVEY BOOK 1, PAGE 83, IN SECTION 35, TOWNSHIP 23 NORTH, RANGE
17 WEST, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT
SIZE) ZONE TO C-2H/5A (GENERAL COMMERCIAL HIGHWAY FRONTAGE/FIVE ACRE
MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10,
1999, a public hearing ;vas conducted to determine whether approval should be granted to Rezone the above-
described property as requested by Joseph and Mary Gurrieri of Kingman, Arizona, and
WHEREAS, this property is located north of the City o£ Kingman, west of Stockton Hill Road and
north of Jane Avenue. The site is accessed from Kingman via north on Stockton Hill Road to the site,
located on the northwest comer of Stockton Hill Road and Jane Avenue. The property has two steel quonset
buildings on it, one being used as a single-family residence and the other, nearest to Stockton Hill Road,
being used as a garage. In addition, there is a travel trailer being used as a secondary residence. The terrain
is relatively flat along Stockton Hill Road, sloping slightly to the east. Most of the property on the western
end of the property is rocky rolling hills. The surrounding land uses consist of vacant land and several
single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for a motorcycle repair business. The
applicant proposes to rezone the five acres adjacent to Stockton Hill Road to C-2H/5A (General Commercial
Highway Frontage/Five Acre Minimum Lot Size). The Mohave County General Plan designates this area
as a Suburban Development Area. The Long Mountain Area Plan designates this area as RR/5A (Rural
Residential/Five Acre minimum lot size), and
WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area. Additional comment: Do not obstruct the wash
crossing the parcel, and
WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan but does
not comply with the Long Mountain Area Plan.

c. The site is adequate for the action intended, but the use is inconsistent with the surrounding
land uses and terrain as the nearest commercial property is over three and one-half (3½)
miles south on Stockton Hill Road toward the City of Kingman.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
April 14, 1999, the Commission recommended DENIAL for a Rezone based upon the following:
1. This request is a spot zoning as the closest commercial zoning is over three and one-half
(3½) miles south of this location.
2. This request is not compatible with the Long Mountain Area Pltm, as this area is designated
as RR/5A (Rural Residential/Five Acre minimum lot size).
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
cimulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 10, 1999, DENIED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
