HomeMy WebLinkAbout99-176 ~ ~ OFFICIAL RECORDS OF HOHAVE O]UI'~TY~ AZ JOAN MC CALL, MOHAVE COUNTY RECURDER ~ ~'~ ~. 05/12/1999 02:50P PAGE ~ OF :~ ~IOHAVE COUNTY 80ARO OF SUPERVISORS RECOROING FEE O.O0 RESOLUTION NO. 99-176 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF PARCEL 235, AS SHOWN ON RECORD OF SURVEY BOOK 1, PAGE 83, 1N SECTION 35; TOWNSHIP 23 NORTH, RANGE 17 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 10, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Joseph and Mary Gurrieri of Kingman, Arizona, and WHEREAS, this property is located north of the City of Kingman, west of Stockton Hill Road and north of Jane Avenue. The site is accessed from Kingman via north on Stockton Hill Road to the site located on the northwest comer of Stockton Hill Road and Jane Avenue. The property has two steel quonset buildings on it, one being used as a single-family residence and the other, nearest to Stockton Hill Road, being used as a garage. In addition, there is a ~ravel trailer being used as a secondaxy residence. The terrain is relatively flat along Stockton Hill Road, sloping slightly to the east. Most of the property on the western end of the property is rocky rolling hills. The surrounding land uses consist of vacant land and several single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A- R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone for their daughter to live in. The Mohave County General Plan designates this area as a Suburban Development Area. The Long Mountain Area Plan designates this area as R1U5A (Rural Residential/Five Acre minimum lot size), and WHEREAS, a review of FEMA FIRM Panel #040058-2155B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional comment: Do not obstruct the wash crossing the parcel, and WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. e. There are no significant enviromnental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 14, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a secondary residence on the A-R/10A (Agricultural- Residential/Ten Acre Minimum Lot Size) zoned property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per the Mohave County Zoning Regulations, the secondary residence will be used for non-paying guests mad relatives ONLY. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, enviromnental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. 6. This Zoning Use Pemfit is approved for one year and expires May 10, 2000. Travel Trailers allowed as secondary residences shall be approved by the Board of Supervisors in one-year increments following a recommendation from the Plamting and Zoning Commission. An application for an Extension of Time must be applied for. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1999, and posted on April 23, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. F'~¥:~E .'~: OF 3 RESOLUTION NO. 99-176 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regulax meeting on Monday, May 10, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
